I am working in IT industry for last 10 years, and it is really easy to demostrate a highly technical experience as being progressive, just need the right attorney. I am assuming there are lots of people here on this board who are working in IT Industry and we all know how fast technologies become obsolete in our industry, you need to be updating your skills and learn new technologies contantly or you are gone, now that in my opinion is progress.

It is really hard for let's say a school teacher who has been teaching the same subject for last 5 years or to the same grade to demostrate his/her experience to be progressive, not that it is impossible, just difficult.

just my opinion.
I am not too keen for EB2, even EB3 is ok as long as I could get my GC, I might have to wait another month or so to apply in EB3.
or may be, since I already have one 485 pending, I need not apply another one, just exploring options.

I assume that you should have progressive experience after your engg. graduation, as you have 10 years experience. In that case you can apply through EB2, if your employer can accept it and prove that they need an advanced degree or 4 years bachelor with 5 years progressive exp.

But check with some lawyers.

Once labor certification is approved, the USCIS permits substitution of alien beneficiary in the approved labor certification application at the stage of I-140 immigrant petition. This substitution has been very popular and widely utilized by the employers as well as the aliens. The substitution has a particular importance nowadays because of the EB-3 visa number backlog. Since the substituting alien benefits from the original priority date of the labor certification application, the substitution may be used as a means to bypass the EB-3 visa number problem

Last night I saw the processing dates for SF DOL on 03/15 as "Cases shipped to Backlog Center". Does that mean that all the cases including some cases of 03/31, complete April cases have been moved to BEC. If this is so, what a pity, disappointing situation it is for April cases. I'm really disappointed with the way things are going on.
Any comments/facts on this information

What u saw was on immigration.com updated on 3/15 and not cases with those dates.

Now the link states that all SWA related cases are transferred BEC. Currently dol has not published any dates for cases under process at the regional office. You need to depend on the threads and currently as per the thread they are processing 3/31/2003 and cases having pd April 2003 are still at RO SFO.

Where did you find this information ?? (03/15 onwards shipped to BEC)..

SF DOL still processing cases with RD 03/31/2003. AVM updated on Friday March 18th still says "RIR Cases with RD 05/01/2003 Onwards & NonRIR Cases with RD 10/01/2003 have been moved to BEC"..

April Cases are with SF DOL only & SF DOL will continue to work on those cases.

I feel pity for this woman , Terri Schiavo ... Is she in pain for removing the nutrion tube , then inserting tube back ... I cannot imagine if that happens to me .

Anyway, I wish her good ...

At the same, I really do not understand what these senates / federal courts/even the president try to do or try to show something ...
Or they just want common people have something to talk about after dinner ...
every year, there is something to talk about, Last year , it was Peterson's case, this year, there are Michael Jackson and now this one ...
How about War in Iraq , US economy is so 'false ' ...


They should try to make the immigration process faster or improve the system . :confused:

It does not say that all cases on March 15 , 2003 onwards moved to BEC !.. Yeah, It says Cases moved to BEC - which means as per DOL Schedule all the cases which suppose to be moved have been already transferred to BEC. March, April 2003 RIR are still at SF DOL as per original Schedule.

My attorney told that she has replied my 45-day letter on 2/14/05.
She didn't tell me this when I called her last time 2/18.

What FIFO means at BEC

Lot of RIR fellows had expressed some doubt about how FIFO is applied at BEC and Reply recieved from Attorney's web site for fallowing Question should allivate that doubt.

Question:
We are little confused after reading about FIFO and have fallowing questions.

1.Will they Combine RIR and TR Q's to gether and process by PD?
2. Or still the Separate Q's exists and process by PD ?

Does that mean that the western states queue @ SFO DOL has not & will not be moved to the BEC?
And they will be processed before the end of the 2005 @ SFO DOL?

I'm still confused about the order of processing based on posts in various forums. I read there that there will be two separate Qs for RIR and TR alright (and BEC will try to see that the two Qs move together) but RIR-Q for Dallas will be independent of RIR-Q for Philly (same for TR-Q).

Your posts suggest that there will be ONE national level Q and both Dallas and Philly will draw from that list in FIFO.

Which is correct? And is there any authoritative source for that info?

Company spinoff

Gurus,
Our division is spinning off from mother company. Old company will
have 19.99% holdings on the new co. The reason of the 19.99% holding of old company is to show that they only have a stake and is not considered a major owner of the new co.
Problem is that my H1B and federal labor cert application is still pending (RD 02/11/03) with the old co as the sponsor..
Questions/notes:
a. How to re-apply the H1B transfer. How to do it and how long does
it take?
b. Do I need to apply transfer prior to the spin-off or after the spin-off ?
My worry is that there will be a time frame that I may be out of status -
transferring from old to new company.
c. What happens to my labor cert application, do I need to re-start
again from beginning - state and then federal or is the
application transferrable since old co still has a stake in new co.
d. Due to the new company, the lawyers will also change to a local.
Old company HQ is in TX so current immigration lawyers are also from TX.
What is happening is that the current lawyers are not answering
my inquiries above.
