It now takes DOL 5 months to enter it into their system -from the time of transmittal by EDD/SESA.

When was ur case transmitted?

2003, haven't recd. a DOL case number from the attorney yet.
it will probably get entered into DOL database around Jan or Feb.
Mine was transmitted in August and still not received the DOL number.
 
Region VI (SF) Recall of Remanded Cases

The response of the Region VI to the recent release of DOL RIR Review Guidelines is indeed swift. AILA reports that the Region is recalling all the remanded cases except the cases which required only Bachelor's degree with no experience. The SWA in California is reportedly scheduled to return the cases to the Region in the following schedules:
Cases Remanded Scheduled Return to Region

06/2003 12/2003
07/01/03 - 07/10/03 01/01/2004
07/10/03 - present No later than 04/01/2004

From the last 3 - 4 months california DOL is in the same place. It is not moving.

Do you know when it starts moving.

Hi there,

I've been a silent reader for some time and got lots of tips and help from the board.
My case was returned from State after a remand on Dec. 1st and it's got approved on Dec. 5th.

DOL RD: 08/19/02
Remanded: 06/18/03
Returned: 12/01/03
Approved: 12/05/03

Job Description: MS + 6 months?
Job Title:
Job Location:
EB2/EB3? etc..

Job Description: BS + 5 years or MS + 0 years (My employer made it that way)
Job Title: H/W Engineer
Job Location: Bay area
Company size: about 10,000 employees

Remanded Cases

Hello All,

For the cases where DOL sent three options letter and the company choose not to repond, as a result allowed it to go back to SWA.

Are these cases going to be sent back to DOL?

I am hearing they are not considering these cases. Can you please repond.

We need to see some 999.xxx.031 and 999.xxx.032 approvals
(Software Application and Software Systems Engineers). Before bugging my attorney :)

I appear to be having a case number 04393XXX. However the AVM tells me that this is an invalid case. Is anybody else in the same boat ?

From the speadsheet data the Returned after remand appears sporadically which means the lawyer was good enough (Proactive) to request the return of those cases. Wish every body got good lawyer like those. Now its all with states hands, lawyers cannot help because the cases will eventually be returned after remand.
 
Your number is SESA case number, you should ask you HR to get your DOL case number, like 0953xxxx

I work for a company in CA and my labor filed in May 02 and right now I am on my 7th year extension visa. Could I join any company if I got laid off now? What options do I have?

GUys any idea how denied cases would be handeled. My case was denied in July 03. My lawyer sent a request for reconcideration in Sep 03 and according to the Certifing Officer they were waiting for the DOL guidance to make any decision.

Any idea when would such cases be looked into?

Mahe04,

I am in the same boat as you and it would be completely unfair
for the DOL not to take back cases like ours where there was
a pattern by DOL of providing the 3 options NOF letter.

Since many companies chose to be conservative and asked the
case be sent back to SWA for traditional processing the
affected number of people could be large enough. The letter
also had a 60 day deadline whereby if the company does not
respond then the case would be automatically remanded back
to state. In such an auto-remand situation the DOL is taking back
these cases but not otherwise ?

It would seem as though the DOL/SWA would be penalizing
these companies for proactively responding to the letter, rather
than not respond causing an auto-remand, and only such auto-
remand cases are given the benefit for the Nov20th
memorandum ?

There are bunch of cases start with series number 09521590. These cases are remanded back to state in May 03. Could you add those case status in you excel.
