are you speculating that you will get RFE this yr or is it 2003.
For NIW, either RFE or transfer is common. Sometimes, one may get approved if RFE is answered. They just want to make sure that you are working in the area mentioned in petition. There is no issue with job change because traditionally, NIW/EB1 always had more flexibility.
By the way, if you have already got RFE, could you let us know what it was for??

sorry about that. my RFE was from Jan 26th, 2004. As soon as I get it I will of course post the information about the request here. thanks for your info, I will try not to worry.........

Hi,

I have posted a similar msg on the main board. Just found out we have a RFE tracker here.

Our RFE was generated on Jan 26,04. They ask three things for my husband( the primary applicant) and one for me.

For my husband:

1, a letter stating the date of hire, duties, remuneration and prospect for continued employment.

2. earnings statements for the past two pay periods.
( does this mean two last paytubs ? Or something else?)

3. evidence that a waiver has been granted ( my husband was holding J-1 visa entering USA)

For me,

just the evidence of the waiver.

Q:

I came to USA with J-2 visa. My husband apply for the waiver and was granted. I didn't apply for the waiver. In his waiver approval notice it stated that any immediate family member was granted the waiver too. Is it OK I just give them the copy of my husband' waiver for this?

Q:

They didn't ask for the last year tax return and w-2. Is it good if I submit these to them too in case they ask for them later when they pick up my case some day?

Approval time after RFE

My Lawyer would reply to the RFE next week. But my 1st FP was expired.

Any one had 2nd FP at Newark, NJ recently? (with or without RFE)
 
RFE to approval timeframe?

Hi all,
It looks like most cases are having similar RFE's:
Employment letters, paystubs being very common and tax returns being requested on some of them.

Has anyone analyzed how much time it is taking on an average between the RFE response and the approval?

This tracker was started quite recently. As far as I'm aware, there has just been one approval so far - for RDMAR03. You can check though by scanning through the RFE tracker.

It seemed a while ago that approvals were coming pretty quickly after RFE however, this has changed. From reading the boards, it seems that, if your fingerprints are still valid (e.g your first FP, or you have taken 2nd FP), approval may be fairly quick (within one or two months). However, for those with expired fingerprints...the wait seems to be lengthy.

Hope this helps - it's really just my observation from reading the boards.

I checked this week's weekly update pdf on the Fiscal Year 2002 reports thread. While there is no fixed timeframe for approval after an RFE response, it was quite heartening to know that quite a few people whose RFE response date was after 20-JAN-04 were approved last week! This includes people from Jan-02 to Sep-02.

So, let us just hope for the best.

RFE is for a job letter and last 3 months paystubs.

Finally, I got the email from my lawyer that they received the RFE on 02/09/04 which was issued on 01/13/04.

It was for Employment letter and 2 months paystubs.

I fedexed last night with all the details..

Waiting continues again...........
 
RFE question

Hi,

I am new to this forum. Who receives the RFE generally? I don't have a lawyer currently. My I485 was applied by a company that I quit after 180 days and I have been doing the EAD renewals etc by myself.

My RD is April 2002
