here is my story. i came to the US 3 years ago with J1 visa(2-year rule doesn't apply), didn't go back, met my husband, we got married 6 months ago and were living together for more than 2 years. In march i applied for AOS, mybiometrics are scheduled for 4/10/.
the problem is: all thetime that is was here without the status i was working,basically illegal. i have a really good job, paying taxes and due to the fact that my husband is currently in school and his income is not enough to be the sponsor i included my income in I-864.
the RFE that i received says:"For the houshold member's income to be included in the household income,the household's income must have been from a lawful source abd earned while the household member was authorized to work in the US.
submit the evidence that the hoesehold member (me) was authorized to work"
and of course i don't have any evidenc-i was not authorised to work...

my question is: is it too late to find a cosponsor ( my parents-in-law are more than willing to help), or i still can submit the i-864A form ...???

i am a little lost cuz was told that i can use my income even thoug was working illegally -just because applying as a spose of the USC.

please, help.
 
you could get a joint sponsor for the I-864 ...also consult a good immigration attorney right away....b'cause since you said were out of status.... you might need a waiver later on
 
send your co-sponsor's documents in in support of your application, since you can't prove that you worked legally.

she's married to a USC and filed I-485. As long as he does'nt leave the US, he'll be in good shape.
