Returning to the US with H-1B & was asked for travel permit

My brother recently returned to the US with his H-1B. The IO at the airport asked to see his travel permit because his I-485 is in transition to approval.

However, this is no LUD change at the USCIS website.

Does anyone have the similar experience? How soon does I-485 get approved?

It just seems odd to be asked for AP when his H-1B is still valid and I-485 hasn't been approved.

Any insights? Thanks!
 
I am planning to visit India. I have a valid H1 until 2010, I filed my 485 and I do not have AP.

Can you please provide the info. on what is the outcome. I am concerned.

if you have valid H1 visa stamp when you enter US you dont need AP. you will enter on H1 status.

-------------------------officer may be new. one does not need to have AP if one has valid H1 visa stamp .

Ginnu is right. No need to worry about.

That is why I am puzzled. I had H1-B and had always entered with H1-B without being asked for AP.

The officer even congratulated my brother for getting his GC soon.

I recently entered US using H1-B while I did have the AP in hands. When I handed over my H1 visa stamped passport to him, he did ask me if I had the travel document. I told him that I have the AP but I would like to maintain my non-immigrant status and would like to use H1 instead. He said to me that its your choice what you would like to use for re-entry and he do not care as long as I have the right papers. So, need not worry about this situation. Reentering on H1 while being on AOS is perfectly fine. There has been many threads discussing this topic.

Just my 2 cents.
 
Thanks for the responses. I was just confused when original posting states about asking for AP papers. Even in my case, I was having AP, but I got stampted H1 in India and entered US on H1.

I need to visit India due to some family member's illness in near future. My old AP is expired. This is the main reason for asking the question.
