Replacement EAD - Different Validity

Hi

My priority date is Sep 2003 (EB3).

My previous EAD was expiring on 14-Oct-08. I applied for renewal and approved at the end of Sep 08.
But I never received them because of address change and even they didn't even reach USCIS.

I went to locak uscis office, they told me that the card id two year valid and since it didn't return to USCIS, I have to apply again.

So I applied again and got the EAD. I asked for replacement card.But today I got card for only one year validity but this valid from Dec 30 2008.
I am working on EAD no visa.

1) Can I ask them to give me the card with old validity for 2 years.

2) How about my work during oct, 14 to Dec 30.

Iam working for desi commpany.

--------------That is upto USCIS they have given you 1 year validity.
2) How about my work during oct, 14 to Dec 30.
--------Do you have any evidence that EAD was approved? Go online punch the EAD filing receipt number and take the printout and keep it with you for future. If you filed EAD then you also got I-765 filing receipt and keep it with you for future records.

Hi Ginnu,

I have receipt and took online status printout also. My second EAD was approved atleast 25 days before my first EAD expiration date.I was never without EAD while I was working.But for some time I don't have physical card.

Do I need to give two I9 forms to my employer.

Is there any issue that I need to take care here.Does anyone ask me in future about this.

Can I ask USCIS to give me duplicate approval notice?

It is the approval of EAD in the system of the USCIS before expiration of the EAD that put you in safe position without being violaing the immigration law. The card itself, despite its importance, is not the end of the world, you may even lose the card after you receive it in hand and unfourtunately, there is no replacement and you have to apply again. consider you lost the card and keep the print of the first approval in case (you will never need it). Update your I9 to be without gap especially if the human resources person is broad minded and explain the situation and show him/her the online print (or even the online status) in addition to the receipt notice which will link the online approval to that number (this approval will stuck online forever with the application number). No duplicate approval for EAD to the best of my knowledge and you are just fine without any gaps. In future application mention this missing card with application number, date of approval ... as if you received it because it is retained in the USCIS system as an issued card.

When Iam applying for EAD In the cover letter I did mention that I didn't receive the old EAD. Will that create any issue.

------------------- If your I-485 doesn’t get approved before your present EAD expire then you will file for New EAD card and will write the info of present EAD card on form I-765. No need to write the info of the EAD that you lost in mail. The Present EAD that is with you is the LATEST EAD and will write the info of that EAD on future EAD application.
Relax!! you dont have any problem related to EAD.

Thanks for the info.
While I was applying for my present EAD in the cover letter I mentioned that I didn't receive the old EAD.Will any one ask at port of entry Etc..
