rejected 6 yrs ago, now applying for F1 visa again 4 graduate study, experts pls help

Hi Guys,

I have been rejected to be granted F1 visa 6 yrs ago :confused: . I then went to New Zealand to study during that period. I now have a Bachelor of Commerce from a Uni in New Zealand. I am working as a marketing supervisor for a big Australian Corporation in Vietnam but I still want to get a Master degree in information systems coz i believe it will be booming in Vietnam where i am from soon. I believe the US is the best place to get that kind of degree and Vietnamese employers love US degrees. I have a few questions and seeking someone to clear my mind:

Situation:

On the I-20, the date on which I have to be in the US for the quarter is 28th of Mar. So I have really limited time left to organize all the documents for the interview.

1) My passport only has 1 yr of validity left. Would that ok to go to the Visa interview at the Consulate or I need a new passport?

2) Would the rejection incident 6 yrs ago affect my upcoming visa application in any great extent?

3) My brother has been in the US for 8 yrs, he is on OPT at the moment. How could I get around if the consular asked me "you may just stay in the US with your brother"?

4) Any tips on how to convince the consular that I am in fact going back to Vietnam after the acquisition of the master degree (in fact, I am coz I know I cant be as successful in the US compared to being in VN). I know it all about the bondings with family, soceity, property but could you be a bit more specific with examples?

5) Any other suggestions which may increase the likelihood of success of my application?

it needs to be valid for at least 6 months at the moment of entry to the US.

no, if your circumstances have changed and you can prove non-immigrant intent

3) My brother has been in the US for 8 yrs, he is on OPT at the moment. How could I get around if the consular asked me "you may just stay in the US with your brother"?
your brother is there on a non-immigrant visa, and cannot apply for your immigration anyway. You are independent of each other at this stage.
 
Visa information

Actually I came as student to USA for my undergraduate studies. Let me tell you my experience and hope that can answer some of your questions.

1- You should have all your certeficates from school when you are going for the interview.
2- You should prove some how that you will return back after you are done with your studies and the way to convince them is to show them a Bank Statment or maybe something that show that you have property in your hometown so they can understand that you will return back. That is what I did.
3- Your passport is fine I think.
4- About your brother I am not sure.

When I went for interview I just had my high school certeficates, my I-20, Bank Statment and my passport. My visa was issued on the same day.

3) My brother has been in the US for 8 yrs, he is on OPT at the moment. How could I get around if the consular asked me "you may just stay in the US with your brother"? Tell counsel, that your brother also going to come to Saigon and goint to work with me after his studies.

Show your job present prospects, a letter from your present company, also if counsel ask why do you need a degree from US? because you have a BS degree and good job already with you. Still why do you want to go to US for study. Do you have a answer? if your answer is good enough to convince the counsel, you will be issued aF1.
