Recent Approvals - February 2002

Some EB3 dates were current before July2001

guys,

As BVM wrote "on July 2001 Yes, all EB3\'s became current but before that every month EB3 priority date was moving app 4 months at a time. For e.g. June, 1998 became current as of May 2001 (which is my PD)"

No 10====> Nameless WAC01-179 AD 2/4/02

I received a mail from lawyer saying my 485 is approved! I wll check AVM tonight to confirm details and about my husband\'s case also.
My Details:
PD 4/00
RD 4/11/01
ND 5/9/01
WAC 01-179xxxx
I did not get FP notice for a long time. Asked my lawyer to send fax. I don\'t know if he did anything or not. Sent it on my own.
Got FP 1 week later.
FP:1/5/02 (scheduled) 12/18/01(Actual)
AD:2/4/02
It took me a total of 1 year 9 months. Not too bad considering all things.
Thanks to everyone on this forum for sharing their info.
A special thanks to Pcee and Ciba for their tracking efforts and thanks to Vishnu, Jony Lever and all the other guys/gals for making this process bearable.
Good luck to the rest of the waiters! Hope you will get yours soon!
AVM did not change

(#189 of 192) Hi all April waiter,
my wac-011-63-*** approved on end of Jan,2002. got approve notice in mail on Feb2.
my story
ND 04/20/01
AP 06/01
EAD RFE for copy of I-140 approve notic on early July, reply sent on mid July, but reply lost inside of INS.
lawyer sent lots fax to INS, no use, sent second reply on Dec29, looks like lost again, AVM still say on July sent RFE... as of today.
FP done on early Dec,2001: had ask lawyer sent three fax request for FP notice in three month period, but nothing happened, untill one day I called IIO, I found out INS FP Fax# changed, call my fawyer right way to let him known the new #, he refuse to admit he does not have newest INS info in hand, but forced him to sent fax at new #, got FP notice in a week.
RFE for I-485 sent on early Jan,2002. ask for 4 paycheck, 2 W2, X-ray, sent reply to lawyer in one day, reply received by INS in 4 working days. I-485 approved in 4 working days.
I think INS realy speed up. it were take three month for the RFE case, but now only three week.
hope to see more smile face soon.

I-485 approved: after two FP\'s, Address/Emplyer change, Interview, and Police Clearances
Hal Love - 05:36pm Feb 4, 2002 EST
Dear Ciba, ProActive, Unluckywaiter, Interview1, hmmlwtg, and everybody.
I got approval of I-485 at the end of last month.(last week)
- I\'ve done FP twice.
- I changed the address and sent \'change of address\' to INS. (but it was not changed in INS until interview)
- I changed employer more than 180days after RD.
- I had interview at SJ INS local office. (why: two FP\'s are all rejected)
- I-485 approved one week after I dropped \'Letter of Police Clearances\' in \'Drop box\' at SJ INS local office.
Our time was 1:00 p.m. We, my family and my lawyer arrived at SJ INS local office about 20 minutes before the time scheduled.
- Interview stared with oath. (Officer asked to us to tell only the truth, and we just said "Yes.")
- Q/A: Address, Parent\'s name, Date of Birth/Place.
- Any conviction, crime, or arrestment? (Did you go with immigration policeman, or immigration officer?)
As other persons done interview, I prepared documents more than I had to provide, but the officer wanted only....
- Letter of current employment.
- Copies of Tax return w/ W-2, and recent paystubs.
- I-94\'s of all family members.
Interview has done in 40 minutes for four of us, all my family.
(Even though appointment time was 30 minutes/each)
Officer said that she want me to get \'Letter of Police Clearances\' for approval, and interview was finished.
My details here again:
RD: 01/01
ND: 01/01
EAD: 03/01
1st FP ND: 03/01 (appointment: 04/01, done as appointment)
2nd FP ND: 07/01 (appointment: 08/01, done two weeks earlier than appointment)
Interview Transfer ND: 09/01
Interview Schedule ND: 11/01 (scheduled date in notice: 01/02)
Interview Date: 01/02
Police Clearances submitted: 01/02
APPROVED: 01/02
* one tip for the \'Letter of Police Clearances\' to Santa Clara Residency ** -> Just go to the Office of Sheriff of Santa Clara County, DON\'T go to any police departments of any cities.
-> I\'ve been to San Jose PD first and asked to make it ($5), and they wanted me to wait for 2 to 3 weeks to get it, but when I went to Santa Clara County Sheriff Office, they made it($20) right at the spot in 20 minutes.
I\'d like to thank Ciba again for his great effort to help immigration waiters.
You may place my experience at \'Interview Experiences\' in your site.
I don\'t have my history listed on your log, but you may add any of my dates on it.
It was a nice experience with you to get all the information from this site.
Thanks a billion and good luck to you ALL!!!
-Hal

PCee & CSC485, "ND" applied for Labor in May 2000....

I know for a fact that all of 2000 was not current until July 2001. How? My PD is 10/99 and I had to wait till July 2001. If "ND" were from other than India or China or EB2, there would be no question at all. NDEEEEEE? Where are you?

grant me the perm. residency.
My wife (I always trust my wifes midas touch) checked up and woke me up to inform that I got approved. Now I have to wait for her to get approved which is also in the same stage, as we both applied separately.
I just talked yesterday to an IIO who said that my file is \'Adjudication Ready\', so that any time it may be approved.
There were days I had got so fed up and the thought of me returning back lingered. The interesting thing of the whole fact is that I finished my MBA. It is just a permission to stay in US. But for me this journey had been a long one, as having waited for applying alomost 2 years after coming to US and then I missed to apply 485 by four days when the date got retrogressed in April 2000. Had to wait for almost one year when my dates become current.....
Compared to others, I will be exhausting my 6 years in another two months, which is not bad....Been with the same company for this long....
Finally, I would like to thank all these wonderful co-applicants and aspirants of GC who made the last one year interesting by providing valuable suggestions... and special thanks goes to Rajiv Khanna for providing this forum...
I would thank all those regular contributors, irregular contributors, fantatics, gurus, contrarians for their views... thanks to CIBA, PCEE for maintaining the summary....
Will be back with the stamping experience.

Got Approval but...

    sitsit - 06:04pm Feb 5, 2002 EST

    Hi,

I switched jobs after finishing 180 days with my old employer. I joined another company and after finishing my finger printing, I got I-485 approval on Feb 3 2002. My lawyer (from the old
company) says that since I and my new company did not notify INS of the change, the validity of my green card is not clear. Is this true ? Is there such a mandate with regards to 180
day rule ? Please let me know.

Holly Molly my case has been approved
AllanGreenSpan - 09:37pm Feb 5, 2002 EST

Hello,
I am pleased to inform that my case and my wife\'s case has been approved on 02/04/2002.

Case details
=============
WAC-01-224-52XXX
PD 09/09/1999
FP 11/07/2001
EB3/EB2 India (See below for details)

Had to apply for my Labor & I140 twice as my attorney screwed up and applied for me in EB3 even though I had BS+7 years progressive experience. Life was getting dull and boring every day. Survived 4 layoffs(Our team size was 62 originally we are now 14). The fun part is I was expecting a RFE for my wife\'s medical exam(She was pregnant during medical tests). However they approved the case without further exams. I hope this is not a automated message malfunction.

Good luck to you all in your green card journey and in your future endeavors. I will miss all the funny comments, INS gossip etc.

7. Stamping @ SFO Be ALERT !!!!!
Posted By: james_desai 2/5/02 11:00 PM
(#10 of 10) Hi I got approved for me and my wife.
RD : 03/20/01
ND : 04/10/01
No EAD / AP
EB2 - India
FP : 11/03/2001 as scheduled @ Oakland (both)
AOS Approved : 01/28/2002 as per AVM (both)
Received Approval notice in mail on 02/01/2002
Went for stamping at SFO on 02/04,
They asked for I-94 , Two ADIT
photos and passport, when called. Apparently, they came back after
a while asking for I-94, !!! Surprise ... even after giving the I-94
how come they are asking I-94 (only for me), I was shocked..
I gave little more details about the conversation, I had with the
person, then he said okay let me check... After 45 minutes of waiting
, he called again and gave us Passports with the Stamp onto it.
When asked about I-94, he said, it was lying on the floor...
God, I was lucky that he found it, so guys make sure that you stample
in Middle and Sideways your I-94 otherwise, you may face some issue
like me.
ALL the BEST for all guys out there ... things are moving bit fast ..
cheers ...
James
