RECEIVED DENIAL LETTER - help explain please

i dont have the exact dates right now...
here's a summary:
i came here in california - APRIL 2004
left country 3 times
2005 - 31 DAYS
2007 - 24 days
2008 - 24 DAYS
i didnt add the trips in 2002 and 2003 in the summary because, these were the times i was still going to college.

Hey andrea4prez
If you do not mind, can you list your travel dates ?

This may help the reader in this forum to understand your case better.

I wish you come out from this mess with flying colour!

Why do not you take an infopass explain your situation ( if you are very sure about your case) to some higher officer in USCIS before you go for Lawyer.

also technically they sent the denial letter on a wrong address....

If that's the case, it's not too late to appeal and/or dispute the denial in court. If money is not an issue, I'd appeal the denial as it seems to be for the wrong reasons.

i already reapplied...i just received denial letter last friday...but via infopass last month that's the time i found out i was denied and they just told me then that i did not submit enough evidence NOW i got the denial letter and it was with the moral character clause...

Bluntly speaking, if I were you, I would be investing the time to find a qualified lawyer, instead of looking for answers here. DENIAL is a major thing, and you need proper representation when going for another Infopass. Sorry, but this had to be told, for your own good.

I had a lawyer and he was the one who put me in this mess...he told me to apply and i applied too early.... i know the reason why i was denied...i just find it confusing how they give two very different reasons in the LETTER that does not make sense.

As I said my friend, please find a competent lawyer. Do some research. I would start by finding a lawyer closest to the DO's office. Use google maps to do that, and check for references etc.
I know you were hurt by a bad lawyer, but that does not mean that you can do this on your own. You have limited time and must act fast.

anrea4prez,
You mantion now that you did not mantion your trips of year 2002 and 2003 in N-400. I believe you are supposed to list out ALL trips outside USA , SINCE you became LPR. The IO must be wanting you to give those details which you failed to provide. If you have not listed out all trips since LPR in your current N-400 , you must go to interview fully prepared with those details and if need be, make corrections in N-400 right there during the interview.
As suggested here , get a lawyer for your interview. I think you are quite unhappy with your earlier lawyer, but that does not mean you can do without a lawyer in your life if there is a requirement. As such also I find you may be likely to make some errors on your own, and some extra help will not be a bad idea. So stop thinking about the earlier bad lawyer and get a new one.
Enough and good interpretation ( infact to the extent possible ) has been done of your denial letter by Bobsmyth and JohnnyCash . You are still trying to make out more sense out of the denial letter and I see no point .
Just forget the denial letter and spend time to get a good lawyer. That ought to really help you.
Sorry for being so staright and hope you do not take my views offensively.

i said I DIDNT MENTION that trip in the SHORT SUMMARY for this forum BUT it is in the N400 application.

As Sai said, there is no point reading the expert suggestions and doing nothing. Act fast, talk to a lawyer and get the ball rolling before it is too late. Common, there is a clear problem with your case that needs a legal hand!!!!!!!!!!!!!!!!!!!!Good Luck.

You're supposed to mention trips occurred in the 5 years prior to filing.

In form N-400 , under part 7 (B) , you are required to fill out the NUMBER of trips you made out of USA in LAST 5 years . Whereas under part 7 (C) , you are required to list out ALL the trips made by you SINCE you became LPR with details of departure and return.

I didn't list all of my trips across the border to Mexico, but I did put a note on there that we make short weekend trips about 5 times a year, but ignorant us (both my husband and I), didn't write down those trips.
I did, however, write down the last three trips we've had for the last year (as far back as I could remember exact dates). At the interview, the IO also wrote in two trips I had since I filed the application.
She never had a problem with my explanation of things, neither did my husband, when he filed.

n-400 7(c)

Hi Everyone,

I had overlooked this question, I thought the question was list all the trips for the last 5 years. So I only put those trips for the last 5 years, not the whole trip since I became an LPR.

My interview schedule is on April 23, needed your advise how to brought it up to the IO.

Im worried that this lack of information will lead me to denial due to lack of good moral character for not writing it on.

Your immediate response is very much appreciated!

Just mention it went IO gets to that section

Musashi,

Do not worry about it..During interview when the officer gets to that section, mention that I misunderstood that part and only mentioned trips in last 5 years. It wont hurt to take a modified page with all the current information.

I dont see this as a problem. (I am no expert, maybe experts can shed some more light on this).

All the best

additional

its just now when i am reviewing my N-400. I also forget to mention my trip last sept 2008 that last for 17 days.

Everyone, please help me. Should I schedule an infopass before my interview on the 23rd?

I felt so stupid for overlooking these information. I am starting to worry now about my application.

Thanks for your help.

You should be fine.

Just make sure you give that information to the IO at the interview.

1 Good idea is to take a new printed page with your trips to the interview. That way, the IO can just replace the page and be done with it.

Well I am sorry for what's happening to you andrea4rez. I hope everything will eventually work out.

I have had 4 trips outside the US (both in Europe), two of them being 4 months long, I know already the IO is going to give a hard time for them.

Reading some of the stories on this board, it seems like some people are sometimes struggling with the citizenship process. I know one thing, I qualify for US citizenship, and meet all the requirements but if for some weird reason I am being denied this privilege, there is no way I am going to fight it. I do want to become an American citizen but why should I suffer for that privilege? I have my interview next month, if it works, good, if it doesn't well it doesn't but I certainly have other things to do with my money than filing an appeal, hiring a lawyer etc. I want US citizenship but be rest assured that I will not beg for it.

thanks guys

thanks waitingforins2 and asdasd for your thoughts. Im quite ok now and your suggestions are very helpful. I will do it on my interview and will let you know what happened. ^_^

Questions for Phx_Girl

Did you voluntarily tell the IO about the two trips that you had originaly forgotten to mention OR he/she told you that you had forgotten to tell the IO about those two trips specifically, so then you had to own up (so to speak) to the two trips?

Also, in another post you mention that your FP letter was lost. How did you find out it was lost? Mine may be lost but I cannot figure out if it is lost...

Thank you.
