An amendment to recapture 130,000 unused immigrant visas to end the three-year retrogression of EB3 numbers for persons born in India, China and the Philipines was passed on a voice vote.

Good News! Thanks to God. I will be able to visit families soon.

senate passed law to recaputure the EB-3. What will happen next? Maybe the House has to approve it too? The president has to sign the bill before it takes effect. I wonder how long it will take USCIS to put this bill into practice. Thanks!

Too early to celebrate

Read this from AILA:

3. EB-3 Relief: By unanimous consent, the Senate also passed a measure sponsored by Senators Schumer (D-NY), Hutchison (R-TX) and Kennedy (D-MA) that would recapture EB -3 numbers lost from FY 2001-2004 due to processing delays. 50% of these numbers would be allocated to Schedule A occupations.

Both the H-2B relief bill and the EB-3 relief provisions will now be included in the Senate version of the supplemental appropriations bill. However, since neither of these measures was included in the House-passed supplemental, they will be discussed when House and Senate conferees meet to resolve differences between the two bills. In both cases, AILA will urge the House to recede to the Senate on both the H-2B bill and EB-3 relief.

Anyone has idea to what month / date /year the visa availability will move. Will it be current till date once it is signed or till some past date (for ex., say 12/31/2004), as the 50% only is going to be available. Thanks
 
If the House is OK with it. Very likely, it will become a law. We should be able to see it in this summer.

The REAL ID Act (if not passed by the Senate), H-2B relief, and EB-3 relief will be subject to conference negotiations. It is thus important to focus attention on Members of both the House and Senate.

Calm down, everyone. Let's be clear on where we stand.

First, this has passed only one part of Congress, the Senate. The House has explicitly NOT passed this, and the House is far less immigrant-friendly. It goes into a "conference committee" where folks haggle behind closed doors. This is the most significant step - it will either come out of the conference (in which case it is extremely likely to pass) or it will die silently in a smoke-filled backroom.

If it does pass, then the President needs to sign the bill, and DOS needs to take 1-2 months to figure out how that affects priority dates. So the earliest possible month (if it passes) it'll be effective is in my guess August.

if this is passed, will it become current upto date or till some period. for ex., till dec 2004,etc., as only 50% will be available for other EB3. Thanks

It will depend on how soon it's implemented and how DoS is willing to distribute the numbers. Even this percentage (50%) may change after the meeting between House and Senate. Any conclusion now is speculative. I certainly hope EB3 for all contries become current in the near furture. Let's keep our fingers crossed.

EB3 Visa recapture

House-Senate Conference committee agrees on Eb3 visa recapture....

House expected to vote today or tommorrow(05/05/05)...Senate would vote on May 9th after their return from recess!....Hope this becomes a law before the final quarter or FY2005...Else the 27% limit would throw a spanner in the works, starting FY2006...

whats you source for what you said??

No meaning to sound pessimistic, but www.shusterman.com site (look at the ticker) has an update today thats says there is provision to get addditional 50000 visas for nurses (Occupation A).. but no mention of any other visa capture or the original expectation of 130000 capture.
 
As per the shusterman.com, the 50,000 visa numbers allocated for nurses and not for other category. But the increase will indirectly reserve 50,000 visa numbers for other people? if this happens i think priority will move by 1 year atleast...
