Re entry Permit and Returning Resident Visa Question

I have few questions regarding reentry permit and returning resident visa. My brother is currently attending school in Philippines and he is a green card holder. He did apply for re entry permit, but it is going to expire this June 10 2011. Is it possible for him to apply for a returning resident visa before June 10 2011? Also, if he is eligible to apply,is school a valid reason for that?( he is currently on summer school and summer semester won't end until May 27th) If any of you applied for returning resident visa (i think its called sb-1, not really sure) how was the process?How long do you have to wait before you'll know if you got approve? Thank you....;)
 
If the Re-Entry Permit is valid until June 10, and the course ends at the end of May, he still has time to come back. Why does he want an SB1 visa?
 
He should be able to get back just with green card an unexpired reentry permit. You would need SB-1 only if he gets back after the permit expires.
 
As long as he boards a plane before the REP expires, they will let him in if there is no other reason or issue as to his admissibility.

No. If he applies for the RR visa before his reentry permit expires, they'll reject the visa and tell him to return to the US with the permit.

But if he applies for the visa after expiration of the reentry permit, they could deny it and then his permanent resident status will be essentially dead. This visa is a last resort for situations where circumstances beyond one's control prevented a timely return to the US; it's not intended to be a convenience thing.
 
Thank you so much for the info. I'm glad I visited this forum, because one of my mom's friend is trying to advice my brother about getting a RR Visa which I think should not be that easy and the fact that school is not really a reason beyond their control.Also, my brother needs to go back to Philippines again to continue school, can he apply for another re entry permit before the expiration of the old one? Classes normally starts around 1st or sometimes 2nd week of June for the regular 1st semester, and his reentry permit actually expires June 15*.
 
He can apply once he returns to the US but must wait for fingerprinting before leaving again. Also, they might only issue it for 1 year, or reject the application, but chances of that are low. For how long has he already been out, and for how much longer does he need to be out?

Yes, but he must be inside the US when applying for it (including the day USCIS receives it), and the unexpired permit must be submitted with the application.
 
I have a question here. How do I apply for my second Re-entry permit? My first re-entry permit will be expired on June 17 2011 but I plan to renew it before that. How do I submit my current valid re-entry along with my second I-131 application form? Thank you!
 
How do you submit it? You put it in the envelope. However, if it is close to expiring, and you think they will not begin processing before it expires, such as in your case, you do not necessarily have to send it in. Where it asks for the status of the current RP, you can write "set to expire 6/17/2011" and keep it, because unless you are asking for an expedited RP, they will not process it until almost 5 months from now. This way you can travel a little on your current RP too.

i have the same problem as your brother...i'm also studying in the philippines...i already got 2 reentry permits before...last year, we applied for another one, but it was denied since i wasn't able to attend the biometrics requirement since we already had classes...this summer break, we applied for another one...we mailed it to the nebraska service center and they recieved it on april 7...we received the receipt last thursday...we're still waiting for the notice for the biometrics...maybe he could try applying when he gets here, but i don't think he would be able to finish the bio in time...hmmm...

I guess what you're really asking is how they expect you to submit your existing reentry permit when you still need to use it to reenter the US.

The answer is you're supposed to already be in the US when submitting the application, so you wouldn't need the existing one any more.
 
Well in Alabama my brother was able to do the "walk-in" biometrics and it wasn't really busy, this was when he was trying to get his reentry permit the first time.
