Re-entry on TN during I-140

Hi,

On a TN, can I travel back to the US (on a TN) if I have a separate I-140 active (i.e. no I-485) without issue?

I read: "While filing an I-140 or I-130 requesting Permanent Residency does NOT impact a beneficiary's current TN status, filing of this kind of petition can impact a TN beneficiary's ability to travel and re-enter the U.S. in TN status due to the intent required for TN status. For this reason persons who are currently in TN status are advised NOT to travel internationally once a petition requesting permanent residency has been filed."

Thanks.

Would applying for a TN extension (new TN) at a POE be an issue after an I-140 had already been submitted? Wouldn't the I-140 get abandoned that way?

As has been explained here many times, an I-140 -- whether in process or approved -- will have no bearing on TN entry, request or extension, by directive of BOTH CBP and USCIS.
