Question on GreenCard for Future Employment.

Can anyone please help? 4 years ago my previous employer (Company A) applied for my labor certificate and was approved. Now working with current Company B.

I am convincing company A to continue with the greencard processing using the approved labor, I have two questions,

1. If "Company A" agrees to continue with the processing. At what point in time should I start working for them?
2. My plan is to consult under "Company A" for "Company B". Is this legal and common?

Appreciated,

I will recommend ~4 months after you file 485.

Legal - Yes. Common - Do not know. You may do this; Join A when you file 485. Stay there untill 140 approved and 485 filed > 180 days. Then use AC21 to join B.
Appreciated,

Is this a problem?

What about if I join Company A right after getting the greencard and stay for about 6 months and then join Company B again?

What about if I do not join Company A at all?

Thank you in advance!

I feel sorry for company A who is convinced to support your GC, but you have no faith for A.

6 month is probably OK, but no joining A may or may not be an issue down the road.

Can some one please advice in my case :

MY company A has file labor for me in 2002 and it was apporved and he file I140 and 485 toggether .I140 was approved last year 2004. I was working for him as a contractor in big company . Now the big company has change their rules and I can work there only throught preffered vender as my company B wasn't preffered vender. So he put me on Company B payroll ,so I am taking paycheck from company B and my 485 is pending at local office and I am waiting for interview based on future employment of companay A . Will I get any problem during interview ? I want to stay with company A as they file my GC .Any suggestions?

Thanks

Show the employment letter from company B. Using AC-21 rather simple then saying future job at the time interview. Some recently landed up in problem recently posted on this board.

Future Employment : JOB TITILE

Hi,

Currently, I am working on Company A, I found one more company B, the started my PERM EB2 as DBA title, they filed 485/I-140, I got the receipt notice today.

I would like to join Company B, but, in the offer letter the type as "SENIOR CONSULTANT" instead of "DBA". They don't have job title as DBA. But, salary match with PWD.

Could you please update me, what type of RFE/problem, i will get it in the down the line ? please update me asap.

Thanks for your help

USCIS does not care that much about the title. The job duties should match.

Company A can revoke the I-140 if they think you just used them for the GC process, meaning you get screwed and cannot continue in the current GC process, but company B must start it all over for you including a new LC. My advise, stay with Company A for the I-140 approval AND until the I-485 has been pending for 180 days. Then use AC21, change to company B, and company A can no longer do anything to screw with you.
