Please help...I was denied student and my date expired!

I came on november 22 as a tourist and started my papers to change my status to student (i studied 2 years ago in the US, with great grades, but then I went on a mission). My student advisor and I worked on the pappers and she got from nevraska the information that I got denied, but USCIS said pending, so she e-mail them every week asking why and what to do (they don't give their phone), also why I was still pending on the USCIS page. All they said was to wait for the letter of denial via mail. My tourist deadline expired on april 7th and still no letter to appeal. Finaly they told her yesterday 25th of april that the letter said that the appeal was due the 18th and now I have to leave the country. Its insane because they held that information till i had no choice than leave the country and never mentioned, all they said was to wait for the letter that never came, and today the USCIS page says that my case is still pending.
Is there any problem if I cross the border to mexico and explain them that I need to solve this and that I need to go back to utah for other 6 months so that a lawyer can help me?
Will they allow me to do that?
can I cross back and forward just to upgrade my dead line in the US just for this time?
Whats the percent of chance to not being allowed to re enter the US, and how long before I can re-enter again?
 
No offence meant but your post lacks comprehension for someone who studied in the US with "great grades".
You entered the US on Nov 22nd and your I-94 was valid until April 7th? That is odd. It is not the standard 6 months people usually get. It is 4.5 months for some reason. Anyway, you are already accruing illegal presence. Leaving the country and trying to re-enter it again will be very risky. Your defense of "waiting for a letter from USCIS" will not carry any weight I am afraid. As far as I know, COS will not be granted to those who have acrued illegal presence. I would suggest you talk to a lawyer.

USCIS told me that as I wait for the response, i can stay longer in the us even if my visa dead line expired... I just want to renew it instead of extend it. would that be posible?
If I leave US under my sircumstances, how much tim ebefor I can come back?
 
I believe an overstay of more than 180 days (but less than 365) results in a three year ban. An overstay of more than 365 days, leads to a ten year ban. Overstays of less than 180 days do not result in a ban, but may cause problems for the offender on his/her next visit to the US.
I would advise you to depart from the US before you accrue more than 180 days of illegal presence.
