Please help I recieved very bad news.....

Some of you guys probably know my situation ,
I am here in good USA for 17 years in Feb 93 IJ denied my application of removal stating that I am here because of economic situation not political.to make long story short, since than I am in courts of appeal.
Somewhere in middle of the MAY I had lunch with my attorney which he tolled me not to worie about my case,and he explained that he is just waiting to hear from Federal court for conference which it should happen somewhere round July or august, and in few days I should go sign and bring 2 pics for ED application .I did that in and of May.
To day I received devastating news .following:

On March 10 you filed an appeal of BIA's decision with the US courts of appeals second Sircuit.on April-15-2005 the United States Court of Appeals Second Circuit, dismissed your appeal.

The service has no record that you have a Form 1-589 pending. Therefore your Application for Employment Authorization is (1-589) denied.


How could this happen ,I don't think my attorney new that my case was dismissed , and I don't think he was he was hiding it from me, we had the discussion that in case if case get denied we are going to file in supreme court, .I left massage for my attorney ,second time when I called his secretary said he knows why you are calling but he is very busy.
That's is creeping me out In first place if I had the good attorney first time it would never come to this and I would be citizen by now. .
So much time 17 years $32.000 many sleepless nights ,one heart attack, now this ??
I think I could be detained, and good knows.
Do you think it could be USCIS some eror? I heard some realy uncualified workers working there for minimum vages.

I have so good job ,and now this.

Any advice, ?? any word well I am trying to stay calm ..wery difficult.
 
Push hard on your attorney to follow on this. Contact the asylum office where you originally filed your asylum application. This must be a very difficult situation for you.

Do you have a 4 year degree? Apply for residence of Canada.

I am so so sorry to hear your situation. What can I say... At this point in time, you need to schedule an appointment with your attorney - stop calling him and go to his office ASAP! Also, you need a backup plan, so start strategizing.

1. Start shopping around for another attorney - go to some free consultations and find out your options for other qualified attorneys. Do this while harassing your current attorney.

2. Start looking at Canada as a possibility to immigrate. In fact, if I had known about your situation, I would have advised you to do this a long time ago. Go to www.cic.gc.ca and click on the 'Immigrating to Canada' link. Most people don't know this, but Canada is as prosperous as the USA, has the same standard of living, and Canadian citizens can work in the USA quite easily under the NAFTA accord. It takes approximately 1-2 years to apply for residency and another 3 years of residency to apply for citizenship. I personally know so many people who have done this as a back-up and actually ended up leaving the USA for Canada as their destination. Some even after getting their GCs and citizenship! Please contact me if you need additional information. I would be happy to assist you.

3. Do some research on your own. Find out where the application was supposed to have been filed. Request copies of your records, and try to gather documents detailing your 17 years of battle. This is vital should you decide to go with another attorney. Make sure you have everything in order.

4. Finally, start looking into how and to whom you can file a complaint against your attorney, should he give you a hard time. You've paid him $32,000+ in the last 17 years and there are certain laws protecting you from getting abused by attorneys. Whatever happens, do not let him get away with this - especially if he tries to screw you.

I suggest that you shouldn't waste money on the current lawyer, it looks like that he has already given up your case and dump you. you should find another lawyer, immigrating to Canada is another good suggestion. good luck!
 
Lolali! You are also a very good member of this forum, especially you contribute after having been approved long time ago. Sadly, Most members leave this forum because naturalization is a simple and straight forward process.

Care2much, so so sorry to hear about this. I always feel like this e-mail thing is a blessing and a curse at the same time. Here is my advice to you: you need to hire a top most famous immmigration attorney in your state, or further. You paid so much money already...I know...but now is the time to do it for the final stretch! I am sure a top notch attorney could figure it out. Where do you live? Gosh, I am sorry, but I am sure there is a way out of this. Sometimes, I read on this forum about people who already have residency elsewhere, who went to home country 5 times...why is it easy for them?

Any way, let's not be bitter, let's find you a great atty and get this crap over with.

You can obtain free evaluation on www.usacanadavisa.com to determine whether you are eligible for Canadian immigration. They have points for degrees you hold and experience you have.
 
I am sorry to hear this news. As a number of other forum members (including Gilbert) and I have pointed out to you in the past, getting a court of appeal to reverse a denial of asylum is very very very difficult. You would have needed a miracle to succeed at this stage of the game. Most people in your situation are ultimately denied.

You do need to seriously think about other options. Under current law it does not appear that you are eligible for employment based immigration. Your best bet appears to be marrying a United States citizen (a real marriage only). If you go that route the law still presumes that you have entered the marriage for purposes of obtaining immigration benefits and you will need an attorney to help you rebut this presumption.

You really need to think about if you want to spend more big $$$$ to pursue your asylum case. It may not be worth it. The funds could be used more profitably elsewhere.

Do explore the Canadian option.

Lastly pray for an amnesty by Congress.

Hi Eddie,

You do not need to have a 4 year degree (or bachelors), however, you get more points depending on the type of degree you have. Here is what it says on the Citizenship and Immigration web site:

Skilled workers are people who may become permanent residents because they are able to become economically established in Canada.

To be accepted as a Skilled Worker, applicants must:

-meet the minimum work experience requirements;
-prove that they have the funds required for settlement; and
-earn enough points in the six selection factors to meet the pass mark.



You can give yourself a free assessment on their web site as well. Please go to this site and read all about the immigration process. It is well worth your time. http://www.cic.gc.ca/english/skilled/qual-1.html

Oh, man! U deserve your asylum status so much!!! Jesus, I just can't imagine how u feel about all this immigraton crap! Be optimistic, man! I hope u the best! I think u'll get it eventually!

care2much, i would advise you not to give it up. cause i don't think that all the time you waited would go in vain. it's gotta be some way to get out of this situation. especialy now you need to conserve your energy in order to fight it. don't let yourself down! and don't give up!.

like lolali suggested, also there is a way to gather all the copies of your immigration documents sinse day one you started your application until now, is to contact the "freedom of information", www.usdoj.gov/04foia/
by law they will send you all the copies. i did it once in 2000 when i lost the copy of the asylum approval notice and i recieved 121 copies including the notice.

you got it right, that was from napoleon hill " think and grow rich " that's one of my favorite too. that book can change someone's life for the better. i wish all asylees willing to give up on their case to read it, it works like migic once it's understood
