If your case is true, do it as described with no expense

Before suing, it is going to cost you hell a lot of money, again you need another attorney to do so. He will take again money!!!.

Depends upon the state you live, go to state government web site, there is a licensing issuing authority site.

Where you can find consumer affairs - complaint forms.

If you are not able to get this form call Secretary of State office , they will guide you.

You write your complaint clearly , fees paid, if your English not so good catch hold of a right guy, and send the complaint through certificate of post with a return receipt (green) card.

It may take some time, but he will get trouble - if your case is genuine and attorney has done fraud on your case, his license to practise law will be revoked .

Please do it and post the progress.

Every state has an attorney ethics board. Lodge a complaint against your attorney if you feel that you have a strong case. Did you have some kind of written arrangement with your attorney?

Where did you find this lawyer? Is he an AILA member?

For GC processing, our firm also charges for each stage (3 stages - PERM, then I-140, then I-485.) First off, if your case was processed after July 2007, you should not have paid any fees for your PERM process, since it is the law since then that your company has to pay for advertising costs and attorney fees for the PERM petition. It is not unusual for an attorney to charge per stage, as many people do not have a spare $4000-$6000 to pay in one payment.

I don't really understand what you are saying that "he showed a employer who is hiring me while filing petition" and that the business was sold. Please clarify this statement. I am trying to figure out if you really are being taken for a ride or if you are jumping to conclusions. Also, the attorney/company are not required to provide you with any documentation with regards to your PERM LC or I-140 petitions as they are company-sponsored petitions (i.e. company is petitioner.) Are you currently working for this company? I am just really confused with the statements you made.

Suing a lawyer? Yikes. That sounds like a difficult, expensive, and lengthy process. I agree with guru on that.

Regarding your question, if your I-140 is approved, yes, you can use that through another company. In order to do that, you would need to file a new PERM case through a new company and then at the I-140 level, you would submit a copy of the I-140 approval and request a recapture of your previous priority date.

Please help me to understand your situation a bit better.

Best wishes,

If your labor certification priority date is current file I-485 immediately, after 180 days of its filing you can take benefit of switching employers based on AC21
