More Confusion

Today, I visited BEC/Philly center which is located at following address.

I went to the office and there is no reception center. However, I spoke with a woman and she sent two supervisors/Managers to speak with me. They have not provided any useful info, but they asked me to share following info. with all the people like me.

They are not providing any information on any case. They said, they are meeting several people like me almost every day. On repeated requests, they said, they are working 200000 cases from various DOLs of US. They said, they have entered around 11000 cases pertains to DOL/Philly during the months of Aug-Nov and they are sending 45 days letters now on those cases. When I explained them that, my case was filed around three years back, they stated that, they are having the cases with priority dates of April 2001. They are going to evaluate only after receiving the response on 45 day letters in chronological order.

God knows, when my dooms day will arrive.

My details are as follows.

My case started on RIR.
Sent my case to state SESA on 02/13/2002
Case forwarded to DOL/Philly on 07/21/2003

Some people who started their green card processing after mine are getting GCs from my company.

I am thinking of taking legal action against labor department.

So they are saying they are going to wait till they send out 200000 letters and wait 45 days and once they receive response they will sort them and approve according to the date, thats just crazy. I was under impression they would be sending letters ordered by date and would start approving on receipt of confirmation. Sometimes I don't understand DOL/BEC.

I'm kinda disappointed that there isnt a more obviously friendly pattern too. My lawyers are pretty good about notifying me and they have heard not a peep on any of the philly letters for their clients.

As and October 2003 Philly DOL I will just be patient a few more weeks. What will be more important is that they immediately get into processing the responses so we can all benefits from some REAL progress.

In Philadelphia Backlog Elimination Center Tracking forum, sg20165 posted a message that his lawyer received 45-day love letter, his RD is Aug 2004.

You will see that people whose PD is 2002 are receiving letters, which makes sense. However there is not enough data to draw any concrete conclusion, this is just my guess from what I see above. I see all PDs with year 2002, and I think that is the reason why we are seeing inconsistency in philly RD date, people with RD of Aug 2004 has received letters. This is just my theory we will know more as time moves on.
Based on this for now we can only take a wild guess about when we will be receiving love letters.

This is exactly what I was fearing would happen. Icarus replied saying that there are other employees who shall be working on the applications once they come in...Man...don't know what is true. I hope Icarus's info is true.
Well, lets wait and watch...hope they DO start processing in parallel with sending the letters out. My application reached DOL in late Nov, 2004.
 
Mine is Dec 2001. Not a word unless my lawyer is on vacation which is likely knowing her. I don't see any of the others with PD in 2001 stating that they received it either.
 
Centralized Processing of Permanent Labor Certification Program Backlog

*For the centralized backlog processing, the DOL hired a contractor in 2003 to develop the model processing program, which was tested afterwards by the contractor in Maryland under the name of Centralized Processing Center in the form of a Pilot Program. The Pilot Program was completed and closed at the end of calendar year 2003. Apparently, based on the program, the DOL created the two Backlog Processing Centers in Dallas and Philadelphia. The implementation and operation of the program are currently handled by another contractor named EXCEED Corporation in Maryland.

*Review of the Training Manual which was developed by the DOL in 2003 through the first contractor named TMS may shed some lights on the operation and management of the backlog reduction works at the two Backlog Processing Centers in Dallas and Philadelphia. The Manual even includes large number of form letters which the agency was recommended to use from the beginning of processing to the final determination of each application. People may find that the first letters which the lawyers or employers currently receive from the two Backlog Processing Centers more or less resemble the form letters in the Training Manual. We post this publication because people currently remain in the darkness and are frustrated for not knowing what is happening in the two centers. People are reminded that the DOL official who led the Pilot Program last year has been appointed as the Director of National Processing Centers for the PERM program. My RD at Philly is Jan-29-04 and have not heard back any thing from my lawyer.

Any one in Jan-04 received letter please?

I am also 2001, but still haven't heard anything at all! :mad:

I am very happy for those that have received the love letter :) ...happy that there is finally some movement...but also sad to see that BEC is not following any order: letters sent out for 2004/2003 applications before 2001 applications :-(.

I am also VERY confused. My application was transferred to Phily DOL on 10/16/2003. Does this mean that it's already in the Phily BEC center? Or does it mean that my application needs to be moved from Phily DOL regional to Phily BEC and that I should expect a love letter?

EAD/AP during Retrogression...

* USCIS has announced that the USCIS will keep issuing EAD and Advance Parole for those Indians, Chinese, and Philippines nationals who filed EB-485 before December 30, 2004 and whose EB-485 applications will have to remain "dormant" until visa number becomes available. Good news, indeed!

So, does this mean, even if we are unable to file for 485, we can still apply and get our EAD's.......???

To me it sounds like you should have filed the I485 before Dec 30th, 2004 to get the EAD/AP. Even though they won't touch your I485 application unless your PD becomes current, they will issue you the EAD/AP.
 
New findings

Hi there!!!
Here are some interesting finding from my company.
There are about 10-20 people in my company awaiting Fed Labor approval.
5 of them under RIR with Philly PD (Jan-04, Mar-04, Jun-04, Aug-04.....)
another 3 of them under non-RIR with Philly PD (Sep-04,Oct-04, Nov-04...)
My HR told me that they received the 45-day letter for the 3 guys applied under non-RIR though their PD are very recent.

Thought I might share this info with you.

Anyone from CA got letter ?

All cases after April 2003 RD have been transferred to BECs from CA. These cases should have PDs around April 2002.

Anyone got any letter in this range ? :confused:
