Hi Ravi,

Would you pls. clarify whether the date of filing in Virginia SESA was Oct.2002? Mine was also filed under EB2/RIR in Dec.2001 and am still waiting. Would you pls. post your reply?

I think its taking 3-4 months for RIR at DOL. This thread is your best source to see the approval pattern.

To answer ur other question, NO..you can NOT change company and use the old LC. When you change employer you will have to start afresh from scratch. LC is particular to the company. You will be able to change jobs safely, once 180 days passed after concurrent filing(I-140/I-485).

RIR for Software Developer

Hi,

Would really appreciate any information on the processing of RIR Labor applications for "Software Developer" position in the recent past. The company I work for has not had any layoffs.

My ETA has been certified (dont know what ETA is, but I guess its Labor vert).

My lawyer has sent me an email that we will be beginning our I-140 and I-485 process since my ETA has been certified

My case details are:

Applied at Philly DOL (Virginia SESA): Sep 19th 2001 EB2, RIR
SESA Certified: Dec 16th 2002 and sent to Philly DOL
Got approval info today from lawyer (Mar 17th, 2003)

I cant emphasize enough, the sense of relief I have. I have been reading all the negative news on this message boards. Some info on my case. My comp has not been thru official layoffs. I have a masters degree (MBA) from a Top 50 American Uni and about 8 years experience. Working as a Project Manager at a Software consulting company.

Good luck to all you guys. I hope to see you guys in the I-140/I-485 forums!!

Congratulation and Good Luck with I 140 / 485.
It makes the rest of us feel good everythime there is an approval as it gives the rest of us hope.

Hopefully the new "WAR" scenario will not impact the processing....

I've heard that things are not as bad as it seems on this message board.

Previously they used to certify 95% of the cases. Now that number may be certifying 75%. A big jump, but still 3 out of 4 cases get certified!!
 
Non-RIR is stuck at MAY since Dec

what's happening with Non-RIR....this is the fourth month that they have posted MAY as their processing time..
Many other DOLs are doing good (all below is for Non-RIR)

NY-Jan03
Atlanta -July02
Chicago-July02
Seattle-Mar03

Is philly stopped Non-RIR for a while?? or did they receive outstandingly number of application in May?

Is there anyway to get this to their attention (ofcourse they do know) and get 'em moving? Like Attorneys calling them and enquiring wat's gonna on?

Remanded to employer

DOL remanded my application back to my employer....
for some reason it was returned to sender (DOL)

DOL Certifing Officer called my company and stated she needed additional advertising info! My employer stated the info she had to send back to the Certifing Officer over the phone to her. The Certifing Officer stated that it is more than enough and all she needs, and upon reciept of the documents she will forward me on to the next stage!

So, I am crossing my fingers!

My employer asked why such the delay on RIR in Philly DOL!
The lady stated that they have had pressure from above to be more indepth in Certifing cases.....but stated this does not mean that the dissaproval rate is greater.... in fact the approvals are higher than previous 911 (but they have more applications since 911.... it just takes longer with the new process!)

RIR recieved in DOL 09/03/2002
remanded to employer on 03/03/2003
DOL phoned on 03/17/03
within 30 days I should be through!

My labor is approved details are as follows applied from Harrisburg SESA 10/22 EB2-RIR rcvd Philly DOL 12/09 and approved on 03.21.03.
All the cases(around 15) applied by my employer in the month of October and November got certified. It looks like Harrisburg region and my company profile is not affected by soft economy.

Did you receive any letter from Philly DOL when it moved from SESA to DOL?. (MY LAWYER DID RECEIVE NOTICE FROM DEL SESA- YOU CAN CHECK ON AUTOMATED PHONE AT PHILY WITH PHONE NUMBER ON YOUR LC)

What is your job post details and experience also?. (ADVERTISED TWICE IN DE+SYSTEM ANALYST+>5 YEARS EXPERIENCE)

And finally how big your company. (SMALL COMPANY WITH 30 EMPLOYEES)
