Substitution filing.

As my labor still pending with PD April 22 2003, and the company had got a approved labor with PD April 22 2003 with the same qualifications and same job.

I(or say company) had decided to use the substitution to file I-140. Papers sent out to lawyer today and will probably file it on monday. And as I have no more patience to see approvals taking months/years decided to pay $1000.00 for premium processing.

Hope the journey from here is going to be not as bad as Loabor waiting.

Hope every one will get their approvals soon. Wish every one the best.

If i come to know about my approval by any chance will post the details.

I had the same issue. The reason why I was getting network error is: I have static HTML page with pre-filled my ETA number in text box and on body load, it has auto-submit. It throws network error with that auto-submit.

Looks like the on application server/machine is down since after noon.

I am receiving this error: Gateway Timeout
 
All I-140 filers with labor substitution...

I-140 filers with labor substitution, are ineligible for premium processing under certain conditions:

- A second filing of a Form I-140 petition while an initial Form I-140 remains pending;
- Labor Certification substitution requests, unless the original labor certification is submitted with the Form I-140 requesting the substitution; and
- Duplicate Labor Certification requests (i.e., cases filed without an original labor certification from the Department of labor). ​

Seems like this hosted url is down

Its been down for quite a while. They care less about this status site. Hopefully some Web Admin gets notification and wakes up in the morning and reset the url (web site)..

And, when it comes up, you will find your case CERTIFIED.

* Even though the processing time of traditional cases at the BECs is frustrating, the launch of the website processing times report will allow the traditional case applicants to check the status of processing of cases in the BECs.

10/26/2006: BEC Traditional Labor Certification Processing Time to Remain April 2001 for Sometime to Come

* AILA has reported that the BECs are still processing April 2001 traditional cases for the traditional case track and it is not expected to move ahead for sometime due to the huge number of 245(i) cases which were filed in April 2001.

Could potentially explain why the site is down.

Congrats to all who had Labor certified lately... seeing mid-late 2002 cases, I guess there is still hope for cases like mine from early 2002 and others from 2001.

Hang in there and I keep telling myself the same....

Does anybody have any idea how long it takes for Phili office to mail the actual approved labor certification letter to the employer?

Its very arbitrary . I am also waiting for the mail

Having waited for so long I am even having trouble believing that its true. I have checked the site several times today and it still shows as certified. So, I guess I am not day dreaming and it is indeed certified.

I guess now the wait begins (like so many other people) for the hard copy of the certification to get delivered .... and then slowly onto other stages ....

Naaa, I don't buy that. I have checked status quite a few time over the weekends. Yeh, its possible that they might be scheduling some downtime over the weekend or off hours.
