you need to send all the information, you have, like ur name, employer name, ur case number from DOL etc, send this info to the email address in my signature. if you don't get a reply in 1-2 days, ask ur attorney to send the same email, requesting the screen shot for proof of H1-B extension.
 
Good news - Labor approved!!!!

I received an email from my attorney on Thursday that my LC has been approved. I was out of town last week so I just got the information today. Wow, what a relief it is, after over 4 years of waiting!! Here are my details:

VA EB3-RIR
PD: May 14, 2002
Moved to Philly DOL: Jan 9, 2004
45-day letter received: Dec 30, 2004
45-day letter replied: First week of Jan 2005
Labor approval: Notified of approval by lawyer on June 15, 2006
**************************

Now it is going to be another wait for my priority date to become current -- EB3 from a retrogressed country. Will go ahead with filing I-140 though.

My sincere thanks and best wishes to each and everyone who has contributed to this forum. Hope all of you get your approvals soon.

Hi Guys .....

If my labor is approved and have applied for I140/I485 and my work location is moved to a different state.. Do I need to need to start the process from scratch (labor and I140/485) or it doesn't affect my current application once i have labor approved and I140/485 is filed.

Thanks, kiran00. My PBEC case # is P-04268-XXXXX. I currently do not have information regarding the exact date on which the LC was approved. Rest of the details are in my signature.

kiran00, it looks like they have started re-visiting the "skipped over" cases. Besides mine, there were two other early-2002 VA approvals reported last week - one from March and the other from April. I have a good feeling that yours will be coming soon. All the best.

Make sure your employer company address remains the same until you receive your labor

In your labor application look at your employer company's address (headquarters).
If you did not receive 45dl and your work location changed, then your attorney has to respond, when the 45dl
comes, saying the company intends to employ you at the address mentioned on labor application though your current work location is different.
Since, you have received your 45dl and your company already responded to it, your new location does not matter now.

HR folks are saying that they need to just sign some document and
Fax it over to backlog /labor center.

Does any one know the exact procedure of replying? if Faxing back one of them?
Just wanna make sure its the right way.

45 Day Letter Reply

You can either reply through FAX or through mail. If you want you can do both.

Since you have already replied for 45 day letter ther is no problem for Labor petition. However it is good to maintain your location till you file 485 as USCIS is qustioning changes in loaction other than the one approved for through Labor. You could move to another office and work on H1b as long as you notify USCIS. But at the time of filing of 485 you have to mainatain the same loaction ( atleast the City)

This I think is the basis on which they have issued new H1b guidelines where they want your employer to state as to where you will work for 2-43 years or so

This is getting tricky with USCIS as well. To avoid any issues it is better if your employer mainataion an office till that time. Consult an Attorny on this as well as Guidelines from USCIS might change from time to time

Do Both - Fax and Mail along with Certified, Return Receipt. BEC's are notorious in closing cases even after they were duly replied on time. Mail it "Certified with Return receipt".

whats the chance of getting labor approved if you receive a "Notice of Findings" letter from Phili DOL? Any suggestions?

Sent an email to PBEC a month ago asking about my case status. Got their response today. They assigned me a case number, which seems to be generated on the 157th day of 2005 (P-05157-5xxxx ). However, my lawyer hasn't received any 45-day letter. Can this be possible?

My PD is April 2004. Anybody knows a similar case?

Below is the email reply from PBEC:

The subject case P-05157-5xxx has been received by the Philadelphia Backlog Elimination Center and is currently awaiting further review by a Backlog Elimination Center analyst. Due to the large volume of LC Applications currently being processed by the Backlog Elimination Center; we are unable to provide you with an exact processing time. If you need additional information, please visit the following Internet website:

http://www.foreignlaborcert.doleta.gov/

There is no need to submit multiple requests. If you have not already received one, the next notices that you will receive from this office will be a 45-Day Letter and a Selection of Continuation Option letter.
 
This happened to me as well. I got my 45-day letter almost an year after my case was entered into the system. Probably sitting in the mail department for an year.

It is normal. I got my D number 5-6 months, before the lawyer got the 45 day letter.
