can you talk to your employer and tell them your situation. Most US companies are sympathetic towards such situations. Maybe as LuckyLucky said you can stretch your pay-stubs over the next 6 months and ask them not to cancel your H1 as yet.
Or negotiate with your employer to work part-time say 10 hrs a week or something tot hat extent. Just so you are an employee and tide over the next 6 month period.

You should be able to get ur LC certified and file for 140/485 in the meantime and start looking for a new job.

if you can afford expend a year in F1 status (student) you will clean your H 6 years count and try to find a job during that time.

NIW is incredibly dificult to obtain. It s not based on papers but on the fact that yu have to convince litterally the INS agent that yu deserve the green card just on the base that your job would benefits the nation altogether.
I sent several Emails to attorneys, some told me it would be agood idea to try NIW. Convincing a INS agent about the good of nuclear energy isn t such a problem. After all Bush decided a month ago to go for the nuclear option to solve our energy problem. And showing nuclear energy is a benefits for our society wouldnt then be very hard.
The major problem for me being the large amount of perfect recommendation letters . I am 32 and i obtained my PhD 3 years ago. I am not sure i know 5 eminent persons in the field.
I could get a hand on 2 or 3 recommendation letters. Most from my home country.

Now for the attorney part... The fee is just about 3000 dollars which isn t that much. I do suspect they are asking for more recommendation letters because they are, after all, only making research on my field without necessary having an expertise on it. I would think that fewer recommendation letters and maybe a report writen by me could do the trick.

In any case. This is my last option.

Is it true that since July the PBEC has stopped 45 day letter mailing (except for special handling) to focus manpower on data entry? It is believed that PBEC tries to have all cases entered (brief entry only) by September, then sort all cased by Priority date, then start the 45 day letter campain.

Heard it is their goal to finish all 2001 cases (RIR and TR) by the end of year 2005. But again, how can you ever trust the DOL? :cool:

I just emailed the reporter who did a backlog piece on Washington Post to thank her for the good work. Finally somebody did something.

sorry to hear about your situation.
I have a Ph.D and I explored NIW for a while. here is a useful article on NIW that i got from the NIW forum here http://www.twmlaw.com/site/resources/immigrant/immigrant9cont.htm

in short you have to prove the following three:
# The foreign national’s work is in an area of substantial intrinsic merit;
# The proposed benefit of the foreign national’s work is national in scope; and
# The foreign national will serve the national interest to a substantially greater degree than would an available U.S. worker having the same minimum qualifications.

the hardest part is to prove the last one where you will have to document that specifically your qualifications and achievements are better than others for the same position.

You may also argue that your company is taking a financial hit by letting you go through the labor process.

Several peopel advised me that EB1 is perhaps easier than NIW.

Lastly, I would explore post-doc options. post-doc is easier to get as it is a short term commitment for the prof. try Los Alamos National Lab.

All Guys ...please write your senators for supporting McCain/Kennedy bill...
This increases the visa numbers from 140K to 290K... would end retrogression instantly.....This would also recapture the unused visa numbers..

Also oppose cornyn/kyl bill because it cuts down EB1/EB2 numbers and gives those to unskilled labor....This does not increase visa numbers and would increase all skilled immigration backlogs....


I recently read the text of Cornyn/Kyl bill from shusterman's site...If that thing gets through....we are f*cked.....EB1/EB2 numbers cut down to 15% each from 28%...EB3 increase by a few thousand and 35% to unskilled.....So all categories would be backlogged hopelessly.....All EB1/EB3 would start filing for EB3 as EB3 numbers would be slightly more.....

McCain/Kennedy bill is of no use to us. Without labor certificate everything else is void. I would always choose retrogression over pending labor.
 
Number of cases

Hi ALL,

It looks like 2 BECS have entered around 34,000 cases with partial data from
07-july-2005 to 19-july-2005 based on the following case numbers:

T05188-01*** ( case num from PBEC)

T05200-35***( case num from DBEC, Indiana case )

So looks like total cases in 2 BECS with full data entry + partial data entry = 274,000 as of 19-JULY-2005

McCain/Kennedy bill is very much beneficial to all of us...Without that we would get out of this LC queue and get into another very long queue.

At least you are a Ph.D. and you can try Eb1 and NIW. People from this forum are mainly M.S. I think for Eb1 you have to soliciate 12 recommendation letters, around half of them from other contries to prove you are the best in your field. For NIW you need around 6 letters, most from U.S., to prove you are unique and your research can bring national interest. My friend just have one paper and got her NIW. Are you currently or did in the past anything related to energy projects? In a word, you have to be best for EB1 and have to be special for NIW. I am a biotech engineer and currently doing medical research so I file for NIW. But if your case, you may file under both of the catalog.

It had my employer, my name, the state control number, the PD and the last line read "Transmitted to the USDOL Backlog Center Feb 18 2005"

You might want to inquire with your local state agency about your case. They might give you something similar to what I have received.

Nope I haven't received anything from BEC so far ... and honestly I don't expect to receive anything before next year :(

I am not asking to not to support or oppose McCain/kennedy bill. Technically it doesn't matter yet for us whether the bill passes or not.

I would rather spend time/money raising awareness about labor backlog instead of worrying about some bill which might benefit us next stage. Also please be warned that this bill comes with huge liability: flood of illegal applications (of some sort, similar to 245(i)), and you never know PBEC might be awarded privilege to process these applications.

If PBEC gets more work..there would be extra funding too...They would also come under pressure to finish the existing workload so that they can bid for the next contract.....that would benefit all of us.... I believe that once the brief data entry for application is done...More officers would take part in actual adjudication and it would pick up pace substantially.....
At that point the retrogression would be critical for all EB2/EB3 2002 onwards.....The bill would very much impact the way the things would go...

Is there somebody can tell me what is the difference of EB2/EB3. The ad requirement is bachelor degree and four years experence? Is this qualified for EB2? Thanks

Bachelors with 5 years exp. qualifies for EB2.

Not only that our salary is also contribute. I have Masters with over 10 years of experiece. When I asked my lawyer to file under EB2, he said, my salary should be around 70 K. Due to which my case was filed under EB3.

The position should demand Bachelors with 5 years exp. and your employer should agree to pay the prevailing wage in the locality for that kind of position.

Many companies file cases as EB3 that could be filed as EB2 to avoid paying the comparatively high prevailing wage. (There could be other reasons as well)
