BEC inside report

BEC asking another 24 month additional time extension to finish all backlog. Please keep on sending letters to senator, congressman and Chao.

orissa, thanks for the info. Is it 24 additional months on top of 24 months they got...or 24 months from now? So, are they asking for total of 4 years from Mar 05?? That's insane.
 
DBEC started approving Oct 2003 (RIR) cases.We are stuck with a wrong bunch of lazy PBEC idiots.With this speed looks like DBEC will clear most of the RIR-Regional cases in the next 6 months or so.

Looks like another factor in deciding the FIFO is the region from which your case was transfered.Noticed a few IL cases being approved at DBEC
 
I hate PBEC!

My co-employee's labor certificate (PD Oct 25, 2003) was approved by DBEC. He showed me letter he got from DOL yesterday. He's like mine CA/EB3/RIR. My priority date is Sept. 2003. We are all doom!

Assume you file an application with a Govt agency today. After 4 years the Govt chages the law (PERM) and asks you to withdraw your old application and file under the new system. Is that correct?

If the old labor system and PERM are equivalent why not the DOL do that automatically? (instead of asking us to do that)

Instead of allocating 200 persons for 2 years to clear blocklog why not 400 persons for 1 year? (I know, the budget wont be the same)

Why not charge $500 extra for a premium labor processing to clear the blocklog? (if the DOL doesnot have enough money)

BEC took one year to enter all cases in data base. Instead why not leave the data entry task to each employer (like PERM). That way you can eliminate the 45 day letter and all the data will be entered in 1 month time. Some of the heavy load of BEC is because of the way they want to process these applications.

Does BEC have such a heavy load, so they do not have enough time to even give a monthly update? (Remember by now all the data are in data base.)

My point is... we have a solid case.

Frustrating

Guys,

Is there any way we can get Rajiv Khanna's attention to PBEC backlog issue? We need some lawyers with credibility to push our case in courts/political forums. Our voices are not being heard right now. I have sent emails to Stephen Stephanko and Sen Feinstein but have had no response :(

Talking about frustration my case was filed in Sept 2002 and my co-worker's case was filed in Dec 2002. He has already filed 140/485 and is expecting an EAD soon while those of us who accidentally ended up in PBEC are stuck with no clue as to when we might see approvals.

The reason why PBEC is slow is because the Chief CO/Director of PBEC picked up a total different methodology from DBEC to handle cases. He did this legally but inhumanly.
The departure of Bill Carson shows DOL acknowledged the mess of Labor certification. Our only hope is to force this guy out.

I ask my lawyer thru email regarding my case in LC, the reply was "All cases are assigned to difference officers, therefore , each case is handled on a case by case basis and we cannot give you an exact reason why it still pending". Is this true? any comment for this
 
Dont we have one person in this forum whose attorney is Rajeev Khanna .Does he come on a weekly/monthly chat in this forum.If people like Rajeev Khanna/Murthy/OH cannot really push this to the AILA then nothing can be done about PBEC's speed.Probably the realistic approach would be, all of us just give up our PD's and convince our employer to file PERM.

But it is really surprising to see all these popular attorneys not coming forward to do anything regarding the PBEC.

Forgive me for my ignorance.. Was this Bill Carson the head of PBEC and he was booted off? When did that happen? Anything changed after that?

I share your frustration completely, but it's not really surprising that populate attorneys are not coming forward about PBEC. It's in their interest that more people withdraw their cases and file under PERM. That way they can make $$$$$$$$$.

I think employers are the one who should understand these games being played by lawyers and do something about it. In most cases employers are the ones who would end up paying extra $$$ for PERM.

Lay off

Well, statistics had to catch up...

One of my team members whose PD is May 2002 [CA/EB3/PBEC] was finally laid off last week. After more than 3 yrs pending, he hasn't even cleared labor.

His 6 yrs are almost up and he's planning to leave the country soon unless some miracle happens like he gets a GC in 3 weeks.
