The idea for 180 day is that that particular figure appears in some other existing legislations like AC21 and would be easier to relate with than some other arbitrary number as I think of it...That was the rationale ....

At this point our first bet is reform proposed by Senate Judiciary commitee as part of the budget reconciliation bill.....That is happening in this year...These were the proposals reported on the 20th of Oct...This bill has to passed in 2005. Only thing we got to pull off is get an amendment through that would let us file 140/485 if labor is pending for more than 'X' days period...(put your favourite number there)...This bill would stay under the radar and the proposals would get through as there is no amnesty involved for illegals...

One thing for sure ..this is the time for lobbying....We should lobby so that we get to file 140/485 even with pending labor....
Nobody knows about BECs and doesnot seem to care...

The other immigration bills are tricky. they include some form of Amnesty to illegals and would face opposition....

I cannot believe that I have ended up following this much of American politics....

based on this tracker, i posted the question. My case # is P-04274-XXXXX. From the tracker, the ETA case number like P-04286-XXXXX are certified. Does the BEC goes by ETA case number??? in that case i can contact the atternoy to see what's happening with my case as P-04274 should have been taken casre of before P-04286

Though I would love to file I-140 / I-485 before getting labor, but I do not see any logical sense to it. How can US Gov give you EAD with out makeing sure that there is not another American of same skill, sitting there with no jobs. Isn't that is what ensured by Labor process.

I guess this proposal is relevent only for BEC victims and no new labor will wait for more than 180 days as they have to go through PERM which takes less that 60 days to get approved (afte AD).

I would love to see the CAP removed only, as if so happens, I will file PERM and move ahead with life.

To All,

There are pending immigration bills. They might or might not get through..All we can do is to seek some relief for our situation. I tried to came up with an idea that would benifit us..Now when we talk to lawmakers we have to ask for something tangible....

We can say fix the PBEC mess...They would tell us to go file PERM...Now not all emplyers/lawyers are enthusiastic about PERM and refuse to do it/advise to wait...

Thats the reasoning for request for capability to file 140/485 after a certain time of labor pending.....The very fact that we stay employed for a substatial period is enough to demonstrate that we are required workers. Also for H1B the companies already filed LCAs. So it is very much logical to seek the relief like the one we are talking about....

When you write to people like him, make sure you give him facts instead of guess. No case has ever been pending at BEC for 2 years. For this statement "While people that applied in other states like IL two years after we applied for Green Card, got their labor approved as well as received GC", I don't believe it holds water. Please do not use "we" because you only represent youself unless you can produce another name. Also, I do not understand where "most of the People that are in H1 visa are willing to pay additional amount of around $2000.00" came from. I am not trying to discourage you, but you have to make youself credible.

I wish instead of issuing 7th year extensions they issue us temporary green cards that set us free. These temporary green cards could be subject to revocation if any of theese application, LC/140/485 is denied.

In addition, high-tech workers who have worked in the U.S. for three years may be allowed to adjust to permanent resident status without regard to the annual cap of 140,000. The spouses and children of immigrant workers would also be allowed to adjust status without regard to this cap.

The way I read it...this should render BECs useless otherwise why would they pupt the condition of at least three years US work experience. I'm looking forward to Mr. Oh's analysis on www.immigration-law.com.

Need Advise - Aug 2002 EB3 or Nov 2005 EB2.

Though this is my first post, I have been following the form for last few weeks. This is one the places to get lot of information. You guys are doing a terrific job.

I need advise from all the experts here. I have filed my Labor in VA in Aug 2002 in EB3 RIR. The application moved to region on Oct 2004 and 45 days received and replied in June 2005 time frame. I checked the status on Sep and it was RIR. I didn't check status after that.

My 6th year on H1 gets over in May 2006 and I was planning to continue with existing Labor and employer. I may be forced to change the employer soon.

I want to know
1) if it is advisable to change the employer in 6th year
2) can I apply for 7th year extn in Nov 2005, get the extn, apply premium H1 transfer to new employer, apply PERM (this time in EB2) thru new employer and if I get LC before may 2006, I can continue to get 8th year and onwards extension ?

Basically I want to know if it is better to continue with EB3 Aug 2002 application or will I get GC faster if I file in EB2 in Nov/Dec 2005 ? I am afraid that with EB3, I may get stuck again at 484 even if I get LC certified.

I will appreciate any guidance you can provide and looking forward for it.

My labor was applied in VA by Feb04 .
I didn't get my 45 days letter. Is there any one got letter around this
time.
Is it possible labor will be approved w/o 45 days letter?

Problem is you probably do more harm to people here when you sent that kind of message to Senator "Hazel". I don't believe I can teach you anything. But, if you cannot back up your claims, you better not make them.
 
Letter to Senators and Congressman should quote figures

Numbers speak volumes of inefficiency. Looking over the tracker it is clear the inefficiency of PBEC compared to DBEC.

DBEC has certified 41% of all their cases, PBEC has only certified 10% of their cases.

DBEC has certified 56% of their regional cases, PBEC has only certified 14% of their regional cases.

DBEC has issued 45 day letter for 71% of their cases, PBEC has only done 62% of theirs.

Both BECs have the same resources, same time and same number of petitions.

Of particular interest to us Californians:
DBEC has certified 75% of regional CA cases, PBEC has only certified 1%.

Always state that these figures are based on a survey of over 1000 pending petitioners from across the US.

Numbers like these state clearly to any Senator or Congressman that there is a problem and tax dollars are not being spent wisely.

I have just written to my Senators and Congressman quoting these figures and am only asking for one thing: "Investigation into the inefficiencies of PBEC".

I believe that the numbers speak for themselves and in just asking for an investigation, they can ask their own staff to investigate, and doesn't require a bill to be passed. Therefore I think it is a way to get the quickest response possible.

Similarly feeding these numbers to the media may help prompt an investigation.
