Hi all,
I hope that someone will be able to answer my question. My father lives overseas and is married to my stepmother. They have two children together, an 18year old and a 12year old. I know I can file a petition for my father so my question is will my stepmom and underage sibling benefit from the petition as well? Please help!!

If they were married before you were 18 years old, yes, you can petition her as your stepmother. If not, you can only petition your father. He will then have to wait for his greencard and petition his spouse and children.

There are no derivative benefits for children under any of the family-based categories; even if you can sponsor both your father and step-mother, they will not be able to bring their children. The only way the children will get here is if one of the parents sponsors then under F2A once they get their own LPR. Priority Dates for F2A category are hovering around Jan 03 and the moment, which implies a minimum 5-6yr wait.

Does this apply even if the biological mother is alive? In other words, such a US citizen can sponsor his/her real mother and step mother?

Yes, this applies. A USC can petition his/her biological mother and can also petition his/her biological father plus wife if the dad and wife has been married before the USC's 18th birthday.

This also applies to children, the stepparent can petition his/her stepchildren as long as the children were under 18 when the marriage took place. In my case, my parents are divorced, my mom is an LPR. My dad married a USC when I was 12, the USC never petitioned my dad or me. My mom didn't petition me either (not until I was over 21) so I finally got my green card through my husband.

There are derivative benefits for some family-based cases, but this isn't a family-based case; it's an Immediate Relative.

So given certain circumstances, a US citizen can sponsor a grand total of 4 parents? :)

Yes, this applies. A USC can petition his/her biological mother and can also petition his/her biological father plus wife if the dad and wife has been married before the USC's 18th birthday.

Yes, if his/her parents are legally separated and both remarried before his/her 18th birthday he/she can petition 4 parents, provided he has enough income for the affidavit of support.
