EB2 - BS with 5 years/Level IV/Mechanical Engineer
Not normal...BN letter submitted with audit response.
Audit letter 08/01/2005
Replied on 08/29/2005
10/26/2005 - Certified

This is my friends case. So far my company filed 26 cases starting from 05/04. This is the first approval....all other cases for Programmer/analyst or computer systems analyst. No Audit notification in other cases except one they received yesterday for comp.sys analyst(case filed in sep 05,2005.)

There is no streamlined process...my company called DOL and all the cases been assigned to some officers...they are not sending audit letters.

In the above case DOL kept the audit response for around two months..yesterday my company called concerned officer, he suggested to send email to check status. But, my company didn't, as it is waste of time. DOL sending standard reply for emails. Now they updated their standard reply with two more lines...

" Your case is still in process and official notification will be forthcoming.

Applications are processed in the order they are received. However, because each application is unique, processing times may vary depending on the specific circumstances of the case. "

Finally, I think the officer realized that the audit reply lying at his desk and certified in the evening.

Jun 02, 2005 EB-3 Case Certified

One of my co-worker whose case was filed a day later than mine (first filing), got approved yesterday.

EB-3 / Network Admin / Filed 06/02/05

Suddenly Chicago PLC started working

Still waiting for mine.

cross-referenced with Murthy site...

I hope it's not a temporary surge...but that does look very promising for all the "old" cases...

Something going on with old cases.. out of my company's 26 cases 5 of them filed before 06/28/2005. These cases earlier selected for "Audit review" then "denied" again moved to "sponsorship" and "in process". until last week they were "in process" and also available for online "withdraw". from Monday these case disappeared from "withdraw" list and still in "In process" status.

It appears now they finally start to process old cases. My case filed on June 16 in Chicago showed 'Certified' yesterday (my employer only checked yesterday). I haven't got any letter yet, so don't know the detail.

But it doesn't sound as exciting as it would have been a month ago. With this big retrogression, approved LC can't do too much.

Same here

Online status changed to "certified" today as per hr.
Filled on 8/22 by future employer.
S/w Engr
EB2 (MS+0 or BS+6)

One pending labor in PBEC for PD June 2003(EB3) from current employer.

No excitement due to retrogression. Missed the bus.

Congrats on getting your labor cleared!!
BTW, I'm in a very similar position. Labor pending in PBEC (June 03). Filed PERM last month.
Lets see if we can get some respite thru the impending bill (90K uncaptured visas). :p

PERM Certified

Lawyer called this morning and said the magic word" certified"

EB2
Chicago Center

Final Review 07/08

Now, the question is I already missed the train before 10/01. should I go ahead file the I140 no matter what or just wait the new law get passed and then file 140/485 together? Thanks for your input.
