Hi,

This forum had been always helpful to me. However; recently I received a letter from USCIS stating that they have transferred my case to a local NBC to schedule an interview. Here is just a timeline of my I-485 case:

06/06/2000...arrived in LAX just a few hours before I turned 21 (I was a derivative of my parents political asylum case)
07/01/2001... filed my I-485 adjustment the same time as my parents
03/01/2006... USCIS sent me a letter requesting me to file a nunc pro tunc asylum
11/01/2006.... nunc pro tunc interview
12/01/2006.... nunc pro tunc asylum was approved
04/01/2009....after 3 service requests for my case, i received a letter stating they have transferred my case to NBC for another interview...

My brother filed his I-485 on 2004 after I had filed, and he got his GC on 2006. Unfortunately, when I applied for my I-485, i was under the old law stating I had to file a nunc pro tunc asylum.

Does anyone else have the same experience as mine, or if someone has any input regarding another interview. Much help is needed. Thanks.

It is highly unusual for this to have taken so long if the only issue is about your aging out. do you have an attorney?

Based on the time line you provided it appears to me that you did not have to file a nunc pro tunc application. Did you get married?

Yes we do have an attorney. I was reading the an article regarding nunc pro tunc asylums and they eliminated that procedure. However; when I filed the I-485 back in 2001, i was under the scope of the "old law" which required me to file a nunc pro tunc asylum before they can process my I-485. I did file a nunc pro tunc asylum application, and my nunc pro tunc asylum was approved back in December 2006. I received another I-90 back dated 06/06/2000 (date I arrived here).

Also, I did get married after my nunc pro tunc asylum was approved. To be specific, January 2007.

If you had an I-485 adjustment application pending on August 6, 2002 (which you did based on what you wrote) you should have been covered by the new law.

If that is the case, I do not know why they asked me to file a nunc pro tunc asylum, but it was approved in 2006. I am kinda worried about my case, but I don't have any criminal records, not even a driving ticket. Hopefully I get my GC this year. My parents and my brother are eligible to file for their citizenship in about 2 years. I just want to know if anyone has an idea on what to expect on this NBC interview. Thank you

It will probably be a routine interview. I am just sorry that it is taking so long. You should ask your lawyer to be more aggressive.

Honestly, seeing his client waiting for 9 years and no action taken, those attorney still in business? Maybe he needs to focus on other stuff like real estate or divorce.

Thanks for everyone's response. I received another letter from INS saying that I have a June 2, 2009 appointment for my GC interview. My wife is currently out of status, and I am kind of worried if they ask about her during my interview. Any advice on this?
