PBEC - State of MA - EB3 NON-RIR case tracking

I have a priority date just a couple days before yours March 16, 2004 albeit in EB2, with a case # P-05168-71xxx.

Interesting fact here is that inspite of having so close a priority date, I got my 45DL in Feb 2006, quiet a few months after yours.


A suggestion ...let this thread simply be PBEC-Non-RIR - MA

Doesn't make sense to restrict by EB2/EB3 right now. If at all it makes a difference in processing times, we will get to know that immediately on this thread, instead of navigating thro' tens of other threads ;)

The 45DL was not done in FIFO, and we know from the approvals posted in the other forums that approvals aren't in FIFO either. My 45DL was sent out in May 2006 (although it never arrived), my PD is Aug 2003.

I agree, this thread should not be restricted to EB3. In fact, I hardly see any MA posts for RIR in other forums, so I think RIR ppl should also be welcomed to post to this thread.
 
Call from Congressman Lynch's Office

I got a call from Congressman Lynch's office today in response to a letter I wrote to him about my LC stuck at PBEC. The lady I spoke to had inquired with PBEC about my case and had essentially the same information that I already have now, that my case was closed in July 06, and reopened in August 06, that they are working towards completing backlog by Sep 07, etc., etc. She told me that they have been receiving numerous requests for help with PBEC, and that they are well aware of the problems. This lady I spoke to was well-versed with the standard terminology...labor certification, backlog centers, FIFO, EAD, prority date, etc. etc. She said that there isn't much they can do at this time but wait, but she reassured me that their office was keeping track of all PBEC requests they have received, and will continue to follow up and keep the pressure on DOL.

Online status say today my labour is certified.This fourm is really helpful for me.

I have a sinking feeling though that they are working almost exclusively on RIRs and us TR folks are going to be last in the stack. :(
As yet I don't think I have seen many TRs from any state, let alone MA

RIR always had higher priority or preference and so that will not be a bottleneck. BEC has done with almost 50 % cases and I believe now most of the untouched cases are TR/NON-RIR/REGULAR and we will start seeing the flow of TR approvals in next coming months. Keep your fingers crossed.
 
Following links talk about new rule to be published tomorrow which will allow BEC stuck TR cases to be converted to RIR if Job order is not already been fired.

Logical Analysis:
---------------

1) Tomorrow BEC is coming up with this rule means we can say that
whatever RIR load they might have till now they are done with most of it
and so the system is ready to take new "RIR" load.
2) BECs still have not perfected their system to deal with TR cases and so
they have tried to lure everybody to change the queue from "TR" to "RIR"
with possible financial gain (After this much wait does it make any sense
to be lured by the word "RIR"?).
3) Divert people's attention with giving false hope by introducing another
delay for conversion. People will stop making noise about the delay so far
they have suffered with. And they will not make further noise for a while
with having "RIR hope"

And yes this is "logical" analysis and we all know that BECs do not go well with the word "logical".

I know that a job posting doesn't necessarily mean a case approval. But it looks like we're seeing a slow trickle of recruitment effort for non-RIR cases for MA. Hopefully we should be seeing some non-RIR cases getting approved for MA.
