passport expired

I think this going out hang. I am F1 student since 2006. My passport expired and my visa too in 2008. I have been in usa with no problem. I talked to my school immigration office. they said I can stay in the us as long as I am a student. I just have to renew my I -20. people should stop giving bad information to people. if you dont know just say it.

Having a passport that is valid is a requirement to be here or you will not be legal to stay here.

You have to make sure you renew your passport and I-94 cards are issued only until the experation of the passport unless a mistake is made which rarely happens. I have seen it happen but normaly at customs your stamp on the I-94 cars is up to the experation date in the passport. Your US drivers license will match that day.

You are illegal once your I-94 card expires even if your visa stamp is still valid.

Just common sense.

You are 100% correct, I went thru the same process. I received my new passport in 3 months after applying. Good luck hope you get yours soon.
 
passport expired hey evrybody. I have I-485 pending. I even got I-797C. My passport has expired. I tried to renew my passport since last august, it has been 4 month today. My country Ivory Coast is going through some political trouble. I Call my ambassy in DC but they said they dont have my passport. it suck i dont know when I am going to get my new passport. I am waiting for biometric letter. My question is Do I need my passport for the interview. how important is the passport for interview?

For all you College smart A$$...Can't you read? This is not about being able to renew in the USA. I renewed my passport from the USA and got it back in a few days. Being in the USA on an expired passport might be something your school is not interested in but USCIS is a different government department and under the immigration law you are not allowed to stay with an expired passport or expired I-94 card. You become illegal and it will be in the computer system of customs...

Ofcourse some get away with it and nothing happens but don't give advise that it is a good idea!

Back to the topic that the OP started. He/she is from a country where it isn't easy to get a new passport and the question is "can he/she go to the interview with an expired passport?"

The answer is "try and see how fast you will be denied or on adm. processing!"

The other answer is; delay your interview until you have your passport!

BUT you can also go with these young wise guys who are in College and think they know it all until they will be refused at customs...lol
 
Ohh and you went to the interview with an expired passport? Guess not....that is what the OP asked..but be wise and smart and give advise and meanwhile trash me. I don't care, I'm here legally for more than a decade and did the right thing to stay here.

You on the otherhand need to start reading just a NUVF and read the question the OP is asking, before giving advise and get someone else denied or in trouble by being on adm. processing.

Hey raev...just dont bother to 'update' him....he seems too old to know correct 'tricks'!!
I think the OP knows what he ought to do.
My guess is he may have sent the old passport home for renewal, so he may not have it for the intvw. Hope he has copies of important pages.
If that is the case he should try get a official document explaining stuff from the embassy.
I am sure the DoS/DHS will soon update situation related to this country to the FOs.
He will be alright is my guess.
Of course who knows he may get across an 'un-educated' IO who may rock his nerve a bit, but eventually things will fall in place.

Sad that some on this forum use words like "he may" so often. In legal terms and for a very important thing as the one chance of getting the greencard that so many on this forum and outside this forum desire to obtain...is a very bad way of trying to come across as if this is knowledge.

Ask a lawyer who will not mention "you may"....a lawyer will tell you what you need to bring to be succesful and otherwise the chances are very low.

The OP can always contact the owner of this entire website who is also a lawyer and can tell him what to do....!:)
 
Okay..."regardless if expired" ...and what do you think will happen next....NO Greencard because if your documentation is not as it should be which is a "valid passport" than you will be denied.

But you can ignore it and find out yourself at the interview.

Someone wrote that you can have an expired passport with a valid visa...which is correct....and you need a valid passport to enter the USA and use the expired passport with the valid visa combined to enter the country.

That is a complete different issue. In this case there is a valid passport.

You can apply for a new paasport at the consulate/embassy of your country in the USA and they will sent over the required paperwork to your homeland and sent the passport back to you in the USA. That is totally allowed.

Not having a valid passport as a foreigner and staying in the country is NOT allowed if not a new one is applied for!

It is really surprising (if not bothering) to see how raevsky's clear and to the point explanation of the passport issue is ignored by some members. May I suggest language problems as a reason? From my personal experience, I can confirm that a valid passport is only needed to enter the US. Visa has the same purpose. My passport expired in 2007, and my visa expired way back in 2005. However, I kept being a full time student and never forgot to renew my DS-2019 form, so I was never out of status. I do remember though, that in 2008 my school asked me to renew the passport, but that was the school requirement for renewal of DS-2019, not anything else. So I got a new passport in early 2009, and the officer at the interview had no problems with my status, expired visa, or two passports. He did cancel my expired visa in the old passport, and stamped the new one.

And thanks for the shared experience. Exactly that is what is needed to show that this situation is not a lost cause at all, for as long as the person is still within valid status. The anxiety of having a much different situation than the "regular" applicant can be nerve-wrecking so its good to have positive feedback from close to similar situations
