Passed Test but missing H1 folder, hence no Oath

Folks,

So me and my wife go in for the N400 test on Nov 24th, at the Fairfax office in VA. She passes the test and is granted the oath the same day. I pass the test and comply with everything else and the officer says that some H1B folder is missing to complete my file and hence he cannot approve me for oath and I have to wait till he gets the "file" complete. Anyone been in this situation before? I mean I have had my Green Card for 5 years and where does H1 pop up into this whole thing? SOunds like nonsense:confused:. Please chime in. Thanks.

Sounds like they are waiting to consolidate the A# from your H1B with your current case file. They have to wait until the H1B case file is sent to DO for them to consolidate it.

Think you may have misunderstood. She passed the test and she got her oath and is already a US citizen. She never had a H1 too. Came to US on H4 and then became green card holder. I dont understand!!

So you are the one who had the H1. They need to locate that file for you, whereas your wife's A-file with the H4 in it was already on hand.

Thanks folks, I guess I just get on to the waiting bandwagon. Any clue how long? Anybody been in this situation before?
 
The good thing is that you had your interview already. Once you do the interview, they are legally required to make a decision within 120 days. So you won't have to wait endlessly for them to find this file. If they don't decide your case in 120 days, you have the right to sue to force them to decide it.

Helppppppppppppppppppppppppppp!! So folks, I passed my test last novemeber and STILL no oath letter. I put in a request for information and all i got in response was it is under review. Did an infopass later on and response was it is under extended review. This is SOOOOOOOOOOO frustrating, 8 months and counting for a frkn Oath letter. Any suggestions, I am pretty much drained out of all motivation. SUX big time!!

Contact the USCIS ombudsman to intervene in your case. If that doesn't get you anywhere, consider filing lawsuit.
 
Also you can consider contacting your local senator of your state and they might be able to help you. Call their office and they will guide how to provide all documentation to them so they can further enquire abt your case with INS.

I did the same during my LPR delay and it worked out very well.
