overstayed need 2 reenter my baby wants her daddy

i hope someone can give me the right advice...i'm a mother of a 4 year old girl,her father is a usa citizen,i was living in the usa for almost 4 years after i entered on a waiver permit...i left the country because we had money problems,thats the main reason why i couldnt afford 2 go back to my country before the waiver did expire.i didnt get stopped at the airport,no 1 asked me questions or gave me ufficial papers saying that i was being deport,or that i was not going 2 enter the usa again...my baby keep cryng and she wants to go back to her daddy,do someone knows if i can go back without problems?what should i do?thank you any help will be blessed
 
The child's father can visit you in your home country. Your child can visit the US any time, too. You will not be able to enter the US for 10 years starting from the day you left. Even after that you can't use the visa waiver program any more and you will need a B1/B2 visa, which might be difficult to get if you are still married then to the child's father. In that case he could petition for a green card for you though.

she's only 4years old,she can't travel by herself...i'm in italy and the father of the baby can't get a usa passport due to the back child support that he wasn't be abble to pay cause we went thru a lot of money problems...so even if i didn't have no 1 telling me or giving me ufficial papers about my overstayed am i in trouble?who can i ask if i can reenter without flying half world just 2 get a deny 2 enter?
 
Entering and leaving the country is tracked. Since no exit was recorded for you within the 90 days required for the visa waiver program, its upon you to prove that you didn't overstay. If you try to enter you will be deported back to Italy. Feel free to ask others but everone is going to tell you the same story.

Child support shouldn't have anything to do with getting a passport. Your child is a US citizen and it has a right to a US passport. Just talk to the nearest US embassy or consulate.

thank you 4 ur help...i'm only so sad for my baby...her dad has been denyed for a passport,i can't enter usa,so she will have 2 live with a broken family...we still love each other,and as i belive a family shouldnt be appart just because they didnt have money 2 correct a mistake...i'm so sad and i can only blame my self...my girl is gonna pay the price...if i only can ask 4 forgiveness,i'm not a criminal neither a bad person...i did something stupid and money was the main reason...i'll probably gonna ask the pope to help my family come back together,maybe he will listen...

Well the pope can't help you much either, but if you are an Italian citizen you can petition for residency for your husband and live with him in Italy (assuming you are married to him).

btw i understand that my 4 year old child is a usa citizen,she's actually both,italian and usa...in italy there's an immigration family law that is so easy and 1st of all takes care of the dual citizen children with a permission for the foreign parent 2 be in the country till the child gets 18 years old if the parents are not together or they don't wanna get married...is there any similar law in usa?i will never let my child go and live in a place where i can't get in to visit her or if she needs mammy's help...no 1 with some commonsense will ever abbandon their children...

No, but there is another law in the US. If the child's custody is given to the child's father, the child will live with him, not with you.
 
First,

Please don't use numbers and letters as substitutes for correct words like you are 12 years old and texting your friends from your phone. It makes it hard to understand you. This is a fairly professional forum.

Second, did you take the father to court over child support? How did this come up as a problem for the passport?
 
i didn't bring him to court 4 child support,the ex wife did...so he can't get a passport,and i can't bring the baby to visit...
sorry if my english is confused,i never study english in school,all i know i've learned my self...and i don't wanna type like a 12 year old,i saw people typing using numbers all the time so i tought was normal...
 
It's okay Xamara, you're doing well considering you didn't go to school for English. And this is not a class in English:D

Anyhow, so there is an ex-wife - that's what I figured. You're going to have a very difficult time. You really need to see a lawyer who specializes in American Immigration, but can speak Italian (we don't want to misunderstand something from an English lawyer).

Make sure it's an Immigration Lawyer that does American Immigration.

Make sure they speak Italian as some of the issues you have can be very technical in nature, and you need to fully understand the issues.
 
And if you don't understand something, tell the lawyer "I don't understand". You have a very difficult situation and you don't want to make any mistakes.

You may get lucky, and if there is no record of your overstay then you may be able to rectify the situation. You may even be able to get married and come back legally. But DON'T GET MARRIED without legal advice. There is a procedure for this.

And I like you're saying about "I'll go to the Pope". :)
