Out of status married to a gc holder

Hello,

I have been out of status (f1 visa) and i am getting married to a GC holder what are the chances that the AOS or I-485 would be rejected.

Any suggestion or better way to go about it.

Congratulations. Post more information regarding for how long you have been in the out of status, if any criminal history, working w/o authorization ....etc

Are you been sarcastic or not. No criminal history at all, had worked without authorization briefly. I am back in school, just that i haven't applied to get reinstated since i found out, i could still register for classes without necessarily been back "in status".

If you are adjusting based on an FB2 I-130 (spouse of a permanent resident) and have been out of status, the chances of your I-485 being denied are 100%.

Thanks for the answer but let me clarify one thing first. So if i were to send in the payment of $1010 for the I-485, i will get the money refunded without the receipt for Notice of Action. Is that what you mean by denied.
 
No they will take your money and deny you, also since you are illegal you will be giving ICE your address and information hence they can come around and deport you. Being spouse of a permanent resident provides you no immigration benefits in your case above.
