Got EAD card too

Congrats aptu.

I got my EAD card too (Oct 15th).

Waiting (im)patiently for I-140. ND 5/20/02.
 
hi deeone

i got my I485 ND date is on 09/18 and i am still waiting for my EAD card and I140 aproval. Can i know what is your I485 and EAD ND date. and I 140 status.

I have mentioned all the dates below. Even though I mailed 765/131/485 at the same time, the ND for them are different. I am waiting to hear about I-140.

H1/EAD question

All:

Even though I have gotten my EAD card, my lawyer is asking me too apply for h1-b 7th year extension. Is this required? Any thoughts?


( The argument is that if my 140/485 is denied for some reason, then I will be out of status with just an EAD. But will I not have to leave the country anyway when my 140/485 is denied?)

I filed for I-485 in August 2002, and I got the Receipt number from my lawyer.
How can I find out what the RD and ND are for my application ?

Thanks for your reply and coming to your question
Even in my case my attorney whats me to file for H1 extension. In his words: it is not advised to use EAD until you get I485 approval or atleast i140 approval.
i would say it is better to be on safe hand ... and rest is up to you and luck .... I wish you good luck.

If its a 7 th year extension based on the same GC filing -- if 140/485 is denied -- 7 th year extension also becomes invalid along with EAD. Thats the information I read some site. If its not a 7 th year extension may be thats useful. But on the surface H1 seems more safer than EAD in some cases.

Cheekoo, my friend got a FP notice.

He filed on 10/05. So I expect we should receive something in hand within a week or at the most 2 weeks.

Received ND for I-485 on Nov 2.

I-140=6/20 and waiting.

Questions for the friends here? I only received one ND date for my I-485. Should i ask my lawyer about the ND dates of EAD and Advanced Parole? Or all dates the same as I sent in a packet?

Also would the tracking numbers for EAD and Advanced Parole be different from that of I-485?

How do I track EAD and Advanced Parole?

7th year extension

Friends,
My 6 year H1B period is getting expired in Feb, 2003 and I am planning to apply for I140/485/EAD before the end of this month. I will have 2 1/2 months left between my application date and my H1B expire date.
Is it required for me to apply for 7th year extension?
Will I go out of status if my EAD did not get approved by that time?
Appreciate your thoughts...

I am in the same situation as you are. You can see my previous postings. I got my EAD last month and will not applying for 7th year H1b extension. My H1 ends in another 10 days. :(

If you do not get your EAD before your H1 expires, then you are out of status. It is taking INS about a month to approve EAD & AP. So, if you apply soon, you might get it before Feb.

Also, you can wait until the last couple of weeks before your H1 expires to apply for extension. It is required that INS just RECEIVE your application for you to maintain status for another 240 days.

Good Luck, and please post if you find out otherwise so that I can apply for my 7th year extension soon.
