If you apply I140/I485 and if you do not get EAD before H1 expires, I do not think it is out of status. bcos you applied for AOS and your application is pending. But I may be wrong. What I heard is you can not continue to work until you get EAD.

Any thoughts
 
How long will it take to get the receipt for concurrent filing

I would like to know how long will it take to get the receipt if filed concurrently. To whom do they send the receipt? lawyer or applicant

Hi All,

I got my labor clearance last week. My attorney is working on filing I-140 & I-485 together. I just saw this forum & found out that filing of I-140 date is different than I-485. I mean I checked RD for both & it is different. Could you please tell me why is that ?

Wife's status

Guys,
My wife was on H4B till Jan, 2001 and got H1B thru a consulting agency in Feb, 2001. But she never worked for this agency because of tight market, pregnancy , child care ...etc. Do we need to apply her H4 again now, while we are in the process of applying for I140/485/EAD? Will INS ever bother about the status of dependents in 140/485/EAD process?

Any help is appreciated....

I see that people who applied later than me for I-140 (concurrent filing, Labor substitution) received their approval for I-140 and also their EAD. Don't know when it will happen for me

The Substitution is filled with the INS along with your i140. There will be no rd/nd for this. Once your I140 gets approved, that will be it.


Mine is also a sust case in the same boat.

Could you kindly share your FP experience at VSC. My date is Dec 5, 2002. Pleeez

How long does it take for the attorney to file I-140 and 485 after labour is cleared. My labour was cleared on October 29,2002 and no word yet from attorney.
 
You can take the forms (I-140,I-485, I-765 etc..) and file it. and also get all certificates what ou need.
Bith certificate, Marriage etc...

If you file ur applaction forms then it will take 1 or 2 days.
 
I meant ..how long does it take for the attorney to receive the approval letter from labour department after the DOL clearance. My labour peition was cleared on 10/29/2002..but the attorney says not received the official approval letter yet from DOL department.
 
Lawyer should have gotten it

I got my labor cleared in April, had approval within a week.

In the mean time you can get your documents / medical etc ready to file 140 / 485 / 765 etc. Ask your lawyer to send you the documents. Took me a few weeks to get these documents straightened out and in order.
 
My labor was certified on October 28. We filed for the 140/485 yesterday. Got the labor approval notice in 7 days. Get your medical and document collection done, while the attorney is waiting for the approval.

I am new to this forum. Do you guys know if 140, EAD, AP and 485 are processed separate to begin with ? Does the 140 has to be approved for me to get the EAD or is it not dependent on each other ? Any idea about the time frames ?
 
There is not any rule and regulations in INS. Any thing is possible. .....Who knows your I 485 will be approved before I 140. They say I 485 will be approved around 1 year..and some people are waiting I 140 for 10 months ( approching 1 year). Could be possible 485 will be approved before 140.




Anything is possible in this MESS. INS!!!!! god even doesnt know what's going inside there!
 
Everything is Independant

My 140 appln. is pending for about 160 days. EAD/AP was filed 108 days after filing 140. EAD approval took 49 days. AP is still pending for approval.
I think they are processed separately, but they might be doing some preliminary check on the 140 papers before EAD approvals.

when did u get ur EAD? give me information. I think your ND 10/03.
My RD 09/26 , ND 10/07
I haven't get anything from INS.
 
India-USA...

Online status check says that my EAD was approved on November 13th. I haven't got any confirmation from my attorney. But, my AP is still pending.

Do you have a separate EAC number for EAD and AP?

My lawyer gave me only the EAC (Tracking number) for I-485

Coz, i am checking online alomost everyday.

What is showing message for EAD? I haven't applied for AP.
Coz, i have my H1 B up to Oct 2003. . i thought AP is valid only one year. If I need that i can apply at anytime.
