NSC I-140 RFE Experiances

Hello,
I received a RFE today. I have no idea what the RFE is about. Hopefully , it will get to my lawyers in couple of days time .

1. What are the chances of denial in I-140. My case is a company buyout case , two levels of aquisitions. Couple of other cases similar to mine got approved. My company is one of the fortune 500 companies. So no finanacial problems. The lawyers are also a top notch firm . I dont know what got goofed up in my case.

2. My I-140 was filed under premium processing. if lawyers send the requested documents , then would the RFE be also processed in premium.

One waits for four freaking years to get the labor approved, does all kind of shit job since you are on H1 and cannot move and now this :(

Lets hope and pray for the best.

Hello All,

How long does it take for decision after NSC has recieved I140 RFE response. My RFE was for my Employer Ability to pay i.e tax and bank documents etc.
Please see m details in the signature.

Is it worthwhile to convert my I140 to PP ? Will this expediete the whole process ? My I-140/I-485 are already current and NSC processing date mentions that they are already processing cases filed after me....

Any advice or suggestions would be greatly apprcieted.

Where is the RFE mailed to ?

Does one get a copy of the RFE i.e is the RFE mailed to the mailing address of the applicant in addition to the laywer ?

but as you know uscis is stating that it can take upto 60 days.
mine took 6wks- an EB3 case

with 3 year Bcom (Honors) Delhi university,
1 year Post graduate diploma in Computer Applications(full time),
6 months Post graduate Diploma in software Application engineering(full time).

I also have 1 month full time Oracle Financials Training certificate from concourse Information Technology Internationals (full time)

a 3 month Essentials of Oracle certification from NIIT. Besides 6 years of experience in IT field (as on the date when my labor was filed).

My credential evaluation report mentions as follows:

"Mr. Neerajkhan’s master degree is considered to be academically equivalent to a Master of business Administration as awarded by an accredited U.S university. Admission to this program required a bachelor’s degree. His bachelor's degree is equivalent to a bachelor of science in business administration as awarded by am accredited U.S university. He also has a major in Computer Science based on extensive studies he completed in computer science and the awarding of two Post Graduate diplomas in computer science. This course of study is equivalent to the credits required by U.S universities for a major in computer science. Admission to the bachelor's program required the equivalent to a U.S high school diploma."

Because of all of the confusion around the 3 year degree we have set up a site, www.ccifree.com to do an analysis of the degrees for the I-140.
 
140 EB3 to EB2

Hi Guys,

My 140 got filied on 12 March 2007 with the PD as July 2004 and it was substitution labor (EB3),

now I came to know that I can file with EB2 instead of EB3, But before that, I have a 3 years B.COM (hons) degree with 1 year PGDCA Diploma, 1 year Certificate in Computing from IGNOU ,other Software Diplomas and 6 years of Experience.
Can I still eligible for EB2 Category and will i be able to apply for EB2 if my 140gets approves soon (i wish).

Pls suggest me Gurus.

Mine 1-140 was filed on Feb 16, 2007 (Priority Date: Oct 08, 2003) under normal/EB2 category.

Can anyone please tell me how must time NSC will take to approve it?

According to the processing dates on USCIS website, NSC is processing cases filed around August 2006. Of course, it does not mean that all cases before August has been approved. If a case is well prepared and does not spawn a RFE then it will be approved during the first wave of scrutiny. So when the February cases will be worked on? It depends how many applications were filed at NSC between August 2006 and February 2007. This is likely to be higher than normal because the Backlog Elimination Centers opened the floodgates ...

Also, if the applicants filed after February 2007 opt for premium processing they will jump the queue. Please note that all predictions were based on the assumption that NSC is following a strict FIFO.
 
Need information on I140 Filing at NSC

Hello All,

My lawyer has filed my I140 at NSC (Traditional process). I have decided to go for premium processing (i.e. I have my receipt #) just for the peace of mind. I have read quite a few posts on queries emerging out of NSC based on "educational qualifications".

I have been in the US for 5years now. I am with the same company. Never changed job - been with them for 5 years now.
My question is -

  • Attached all the necessary documents (W2, Tax Returns etc). The only experience letter I was able to get was from my old company based in India. Got 3.4 yrs experience letter stating all my work, skills, experience
  • Degree is B.Com (3 years). Did MBA (IT Management) from an online University in US.
  • Educational Evaluation done from Trusteforte Corp (assigned my US degree of Bachelors of Science in Information Management Systems)
  • I140 is filed under EB3 Category

Does anyone see any problem/issue with the B.Com degree even with educational evaluation from Trustforte? Any bonus points for having MBA (IT Mgmt) from US? Any reply or insight would be appreciated. Thanks!

Is your 1 year PGDCA Diploma recognized by UGC (University Grant Commission) in India? If not, then it can NOT be used as part of your educational qualification.

If the degree/diploma is not recognized, then it is similar to degree/diploma in US that is un-accredited.

Thanks for suggesting me ,actually based on this only my H1 is filed and also my own state labor has been filied, so I think this is valid and also got Education Evaluated,

You were right, USCIS, Nebraska recieved my I-140 RFE response on March 8, 2007 and they approved my I-140 on March 17, 2007. That is less than 2 weeks as you had mentioned. I appreciete your help..

I don't think this is true. There is no criteria anywhere which suggests any degrees or diplomas from India should be accredited or recognized by the UGC. There has not been a single instance of any member on this forum whose I-140 was denied because their degree or diploma was not recognized by UGC. However please do consult with a good attorney on this issue before proceeding. Its hard to give the right advice without learning of similar experiences.

Really? I suggest you call lawyer and check on this.

Up until last year most diplomas, if not all, we approved. I have seen RFE's starting last year. You can see what happens if you apply - you can likely send another evaluation that combines work if you get the RFE. The problem is the cost of the lawyer filing the RFE for you and I have heard that RFE's are scrutinized quite closely.

Asking your lawyer is a good idea.
