No oath letter after 8 months of Passing the interview, N-400.

My interview was done in Chicago on June 23rd, 2010.

I passed the test, but the officer who interviewed me had no words.

I have been waiting to get my oath letter, I and my attorney wrote letter to USCIS and contacted Senator on November 2010.

Still, no words from USCIS. I made many info pass appointment but it was an useless effort. Service request was also mentioning contact them back if I don't hear from them after 6 months.

What can I do? File the 1447b? or just to keep wait?

Advices will be appreciated.

What did the IO mark on the N-652 (the form with the naturalization interview results)? Was it Box B), "A decision cannot yet be made about your application at this time"?

Also, what, if any, response did you get to your inquiry with a Senator? Usually, USCIS provides fairly substantive responses to congressional inquiries.
 
Yes, The office of Senator Durbin contacted Chicago office on November and they informed that my file has been transfered to Chicago local office from the National Records Center that I will be notified.

IO marked the section USCIS will send you a written decision about your application.

I did make a request to speak to the supervisor but denied.

5 years ago, I had an incident (minor physical encounter) with my schoolmate, we were both arrested

but the case dropped immediately.

Hmm. It sounds like they gave Durbin obsolete information - your case was transferred to the Chicago office before the interview, and you were asking about what happened after the interview.
I suggest that you contact Durbin again and ask his office to make another inquiry. Also, find out who is the member of the U.S. House of Representatives for the area where you live: there is a search form at http://www.house.gov/ , in the upper-left corner of that page, where you can enter your zip-code and find out who your House of Representatives member is. Contact him/her as well - they have fewer constituents than Senators and often handle constituent requests faster.

Since it has been well over 120 days since the interview, it may indeed be time to start thinking about a 1447(b) lawsuit. But I'd give the congressional inquiries another try first.

Would it be o.k to file a 1447b?

My attorney recommended the 1447b but asking $5000 to do it.

I have a wife who is Japanese, waiting in line for I 130.

Should I go ahead with 1447b? and does it guarantee the expedited result?

Does Writing another letter to IO help my case to be solved?
