Can someone please clarify this for me?

"The Yates Memorandum on the EB-2 Labor Certification Applications which we reported day before yesterday, 05/24/2005, just stated that a bachelor's degree plus five years of progressive experience in the labor certificaiton application would qualify for the EB-2 I-140 petition, but did not elaborate the definition of "bachelor's degree.""

What is this EB-2? Does this let you bypass the labor (extraordinary abilities)?
I do have a us BS and 5 years of experience?

Can someone shed some light on this? Justwatching?

EB-2 still requires a labor certification. EB-2 is a category for advanced degrees or comparable experience. It may help you when you file for I-140 / I-485 because EB-2 has not experienced retrogression on visa availability compared to EB-3. Althoufh that could change in the future.

Thanks JW. So you are saying that once (when) I pass LC, there are 3 differnet tracks (EB-1, 2 and 3) for I-140 and I-485?
I'm assuming EB-3 is just a 'regular' person (with less than 5 years of experience).

WHat is EB-1?

EB-1 - Extraordinary ability / Outstanding professor and researcher
EB-2 - Advanced degree or exceptional ability
EB-3 - Skilled worker or professional

Criteria For Qualifying for EB-1 Status: Receipt of a major, internationally known recognized award (e.g., the Nobel Prize), on its own, can qualify an individual for EB-1 classification. If the applicant is not the recipient of such an award, then documentation of at least three (3) of the following is required:

Receipt of lesser nationally or internationally recognized prizes or awards for excellence;
Membership in associations in the field that demand outstanding achievement of their members;
Published material about the alien;
Evidence that the alien is a judge of the work of others in the field;
Evidence of the alien's original contributions of major significance to the field;
Authorship of scholarly articles;
Display of the alien's work at artistic exhibitions or showcases;
Evidence the alien has performed in a leading or critical role for organizations that have a distinguished reputation;
Evidence that the alien commands high remuneration in relation to others in the filed; OR
Evidence of commercial success in the performing arts.

I wouldn't call these 'variations', I would call these" OVERLAPS. How do you pinpoint when you case was received, if there are 3 different possible date ranges?

I think they would have grouped them and sent as per different categories. It might be possible that RIR, NON RIR and DOL case could have been sent seperately.

That might not be correct as many of RIR end of year 2001 have not received
45 day letters where as a few received them..

My lawyer told me today that my priority date was october 2002 :cool: . Any news from anyone regarding receiving a letter of this date :confused:
 
HI Extension question

I have labor pending for more than 3 years thru my current employer. I am now planning to join other company. Once I joined the future employer is it legal to apply to 1 year extension based on the labour application of the previous employer?. Any inputs are appreciated. Thanks

You have to first apply for 1 yr extension thru the new company based on pending labor from current employer and then you can join. (You cannot join and then apply for H1 xtension). So the answer is YES.
But make sure your current employer continues your labor application or else you wont be able to get future extensions. Or else file fresh labor thru new employer first, then apply for 1 yr extension thru new employer - this way you will not be dependent on labor filed thru current employer for future extensions.
 
Need help re: 6th visa stamp

I'm planning to go to Canada soon to get my 6th year (i only get 1-year stamps) stamp into my passport. I'm assuming I can do it in Canada (Ottawa), I have a US degree.

When I made the reservation online, it said that we should allow UP TO 3 BUSINESS DAYS to obtain a visa. Is this a true statement? does it really take that long? Has anyone had a similar experience?

I went to montreal for stamping. I got my visa in two hours.

Also, what was the best way for you to reserve Montreal? I tried it for 3.5 weeks from now, but it's all booked. I reserved Ottawa instead. Can I change on Internet (nvars.com) to Montreal without cancelling Ottawa.

I also heard Montreal does it the same day, Toronto delivers it the next business day and I have no idea for Ottawa.

i went to ottawa in feb 2005 ...got it in 2 hrs ...if your appt is before 11 you get it on the same day...unless if your profession is one of the XXX categories like nuclear scientist in which case it can take upto a week....
 
Philly Backlog Status

What is going on at the Philly Backlog Center ?

I sent an email asking for my status on my LC ...... I have sent 2 emails to date ....

My PD is Jan 2002

1st time i sent an email in Jan 2005 and got a response (2 weeks later) of Not Yet Assigned

2nd time i sent an email April 2005 and got a response (1 month later) of Not Yet Assigned

This is getting far beyond a joke ! ....... :mad:
