New York ABC Violation - Problem for getting citizenship?

Hello everyone,

I've had my green card since February of 2005. I thought I couldn't apply before the 5 year mark, but based on reading the posts here, it looks like I can apply within the 90 day window, is this correct?

Also, I was stupid in college and had used a fake ID at a liquor store. The police wrote me up for a violation of ABC law (Alcoholic Beverage Control) and I remember there being a note saying "use of fradulent ID". I paid a small fine and everything sort of seemed like it blew away.

I was wondering if this would severely affect my ability to get my application approved for citizenship. Do you think I should get an attorney? It was a violation, not a felony or anything, but I wanted to see what everyone here would suggest.

I don't think there is any problem but the only way to be sure is to
apply and see what happens. For such a problem, I don't think
you need a lawyer unless you don't care to spend money.

Just file your N400 and see what will come. There is nothing to lose but

Thanks. Also, the guide says 30 months of time as physical presence in the US and 3 months of time in USCIS District or State. When I got my greencard (Feb 05) I was a senior in high school, and I moved to college in New York in August 05. My PR address however has always been in California and I just moved to NY for school and around the country for internships in the past 4.5 years. I plan to get back to California in November 09. Does this mean I have to physically live in California for another 3 months to submit this application?

If the police wrote you up for an ABC violation, it is technically defined as a citation. So disclose it on N-400, but you don't have to submit the documentation or proof of payment if fine is less $500. No, it won't affect your ability to get your citizenship application to be approved since it is not a felony (or since you said it is not a felony).

Yes, you have to reside in CA for 3 month to establish residency. I thought that you need to notify USCIS within 30 days if you change your address when you are GC holder? Am I wrong or is that afternoon latte that makes me tipsy? :confused:

Also, no need to use a fake ID for anything and this include trying to buy a manikin for hallowen party...:rolleyes: Disclose that you were thirsty for alcohol and the law wouldn't allow you to have it, so you shot the law down by using a fake ID....:eek: You need to absolutely disclose this incident in your N400 application. Do you have documentation to prove the citation? If not, find the documentation because a zealot of an IO might give you hard time for the fun of it...:eek:

wait till you are a USCI to use a fake ID, the Bush twins did it all the time...:p

I thought that moving around for college (school) generally did not require change of address. Incorrect?

Correct, you don't need to change your address when you go to college. If you kept your california address all this time, you can go ahead and send your n-400 to the address that CA applicants need to send it to and your good to go. You just will have to travel for fingerprinting, Interview etc back home.
 
All I know is 90 DAYS to your 5th year anniversary, make sure you count every single day, follow that to be sure you are good. The wording could be confusing.....ugh. 30 months maybe for married based applicants that can apply in 3 years but still I think is short......Im not sure on this one.

Remember hun, you are only 23. Put on some nice scent and ask at the counter to be seen by an old guy...no woman.. unless you know she is in the woman-woman scene.

When the interviewer asks you " willing to take up arms for the country?"
Say " make love not war"

If he asks "any trips abroad, like south america?"
Say " I go only on the Applachian trail"...

Talk cool, with the sweetness found in the progressive commercial girl...

He will be so excited he will approve you right away and offer you Mikes hard lemonade;););)

Don't use the word retard during the interview, you might offend the IO or his or her family member might be in this category. You want to avoid hot button issues, be confident about the incident and the lessons learnt from it.

Are you sure about this? If you look at the AR11 form, it asks you if your move is temporary and if so when do you expect to return?

I guess even if a person moves to a different state for college, you should file an AR11 saying you are moving TEMPORARILY for say, 4 yrs but you are maintaining your permanent residence.

Only if Sarah Palin was our VP, you could get away with it , as she can see everyone from her home in alaska, so you probably don't need to inform her??:D:D

Well..filing taxes is a different beast altogether, then you have to have filed for change of address in the first place. Since you benefits from certain tax exemptions and whole shayanola from being a resident of NY, then you will be required to meet the 90 eligibility requirements in CA. Moreover, since you have to list address for the last 5 years (if I'm not mistaken), then you clearly need to resolve this issue asap. 90 days is nada, remember the ultimate objective...blue book...passport. You have already waited 5 years, so 90 days is like passing gas in the elevator, everyone knows its you but you...:rolleyes:

I know less about taxes, because my wife is a the CFO of our household, she knows all tax deductions and exemptions, I just make the money and she pays all the bills, and gives me a monthly allowances too :eek: You can ask yourself, how do I do it? I am in love up to my eyeballs...:D:D Again, no fake ID for anything, even to enter into a lingerie store for women only..:cool:

You can file in CA or in NY. This is your choice. I believe when you are away in school, USCIS makes an exception in this case. I cannot remember exactly where I read this though.
 
Well he filed the taxes more than 90 days ago (rule about living in state for 90 days).....I would hope haha, just make sure about the rules for students etc. A lot of students work when in collegue so I dont think is a bad thing that you filed taxes WHERE you live and work etc.....so I dont think is a big deal.
