Adjustment of Status for Asylees

By law, only 10,000 asylees can adjust status to Lawful Permanent Resident per year; however, the Service is receiving between 25,405– 43,881 applications per year. As a result, as of January 10, 2005, approximately 186,170 asylee adjustment applications were pending. We anticipate that we will process pending applications according to the following schedule:

We emphasize that these dates are APPROXIMATIONS; unforeseen occurrences may delay processing.

Thanks for pointing this out. I bet the shift is not the result of AILA negotiations, but the result of last year's massive fingerprinting campaign that has revealed all the abandoned applications. This reduced the backlog a little bit. I doubt they reacted that swiftly to the negotioations. What do you, guys, think?

This table would become meaningless if the REAL ID Act passed. All asylees would be adjusted immediately, subject to INS processing efficiency.

Dont be so sure kiev! Even if Asylum Cap is removed TODAY, it will take years for BCIS to grant adjustment to all asylees. I can bet my house on that. :(

They just had a lawsuit for their failure to properly manage the asylee adjustment program. So they would probably reallocate resources from other programs to the asylee adjustment process. They want to avoid going to court again on this issue.

Ironman:

What I am saying is that the above timeframe is not reflected on the MONTHLY UPDATED processing schedule (see the link above, they are still processing l Dec 99).

I don't wanna bet but I agree.

Just take a look at the timeline of the refugee based adjustment(jun 30, 2002). Even there are no cap for them they still have to wait almost 3 years.

I don't think that the negotiated extra 31,000 is included in this shift - see on the top it still says "10,000 per year)

Ironman:

No---according to the above timeframe.
Possibly yes-- according to the settlement.

Thats why I said 09/01 this year..and you all were like it makes No sense. I did my calculations just the government way..2 years ago they did fingerprinting and trimmed off 6 months of processing..Once the settlement goes in effect..it should be 09/01 at least by end of this october...!
