Hello! Everyone .. I Want some help Regarding my case .. . I 730 We give interview on 30 june and then They give us one form to fill that form name asylee info form Its now being 7 months but no reply from the embassy .. when ever we call to the embassy they said us ur case is under proces for ( background security check )

There is a person in this forum (shamshon's cousin) whose date is August 2000 and he just got his RFE request. You might want to write them about your case. Atleast they should be near your case..
 
asylum green card

laserthegreat..i read that thread abt aug2000 approval.
but she was'n sure ..had just heared it from cousin.
i will let you guys know whenever i get something.
 
I want to share my story. I was granted Asylum in February of 2000. In February of 2001 I applied for adjustment. On March 10, 2001 I got a receipt of my application.
In June of 2004, I went for fingeprinting. For the last three years I didn't apply for work authorization since I got the email that Asylees are authorized to work in the USA with or without work permit. But because of the problems with DMV I decided to apply for work authorization this gone December 2004 since I knew that my license would expire in August of 2005 and I wanted to be safe.

I received a letter from USCIS denying my application for Work Authorization.
However, the last paragraph of the letter said we are denying you work permit because according to our records you became a lawful permanent residence since June of 2000 and you don't need a work authorization.


I thought this was a joke or something. Since I didn't have an interview, I didn't have any medical exam. But because it was after 6:00 p.m. I waited for Good Friday, March 25, 2005 to call. I called early in the morning and offcourse the first rep. I got was nasty and didn't want to listen to what I had to tell her. She asked for my reciept number. I give it to her and she said based on the receipt number we are still processing your application. I told her I do see that information also when I go to case status for both lins# one for adjustment and the other for work permit. However, I got a letter saying something else.

She hung up the phone in my ear. I call back and this time the customer service rep transferred me to an Officer. The Officer was very nice. He asked me for my A#. I provided it to him and he ask me other pertinent questions pertaining to me to make sure I was the right individual.

He told me that it was not a mistake and that I had been approved since June of 2000 even though I didn't get a Green Card. He said that it was a good thing that I applied for work permit because since then a lot of movement/activity has gone on with my file. My creation of record green card was send for processing and I should receive my card within 30 days. He also send an email to Nebraska advising them of our conversation and to speed up my Green Card. He give me a new LIN # and since then I check it out it did say the same thing. On the 29, of March I check it out again and it said on March 29, our green card was send for processing and you'll receive it within 30 days.

I am so confuse as to how my greencard is going to say June 2000 per the officer and the letter I receive and I only apply for adjustment in 2001. Have anyone heard of such a case. Does your green card goes back to your approval date?
 
There are countries that are exempt from quota

You are probably from one of the countries that are exempt from 10,000 a year quota so you got it so quickly.

How about the one year being present in US rule??? I don't beleive this (I hope it's true though..)

I hate to be the one that is negative, but I want you to prepare for a possible CIS mistake.

From reading your story - there are several possibilities:

1. You are part of the exempt Asylee group and are not part of the 10K a year cap. This makes sense because if you applied in Feb. 2001 and they completed your case in June 2001, the greencard would be backdated one year to June 2000 (per asylee law).

2. Someone made a mistake and put you down as an Refugee instead of an Asylee and your greencard got processed in 2001 - and the date was backdated to the date of entry which in your case is 2000 (per refugee law).

I hope you are in the first category, because this would mean that you would be eligible to apply for citizenship this year! Please let us know what happens with your case.

don't be so confident until you really got the GC

I applied for EAD one year ago and I got the same reply from INS, that is,
"my application was denied because I'm already a permanent resident so INS don't need to issue one to me."
My understanding is that since we asylees actually do NOT need a EAD so that INS consider us a PR only in respect to the EAD application.
I didn't bother to find out if my status is actually PR or not.
But I'll be glad if you can actually get your Green Card thru this way.
My ND is Feb 02.
