My wife's h1 application is being processed now and has not been approved yet. Her passport was valid for more than 6 months when she applied but now she has only 5 months. So we renewed the passport at the Indian consulate. the INS has now asked for my W2 forms etc as RFE. Should I send a copy of her new passport also? Would getting the new passport affect her visa processing?

-----why the USCIS is asking YOUR W2? your wife filed for H1, and we dont know if it is her First H1 or H4 to H1 or H1 extension , please be clear when you post.

---- it means your wife was on H4 and she has filed H4 to H1 Change of status, to make sure she was on valid H4 they may be asking YOUR W-2, normaly they dont ask W-2 if H4 to H1 Change of status is filed.
** getting NEW passport will NOT create problems she should keep both the passports stapled , when she goes out of US for Visa stampng she may have to show both Passports, If her COS is approved with new I-94 attached then no need of Visa staming at this time after H1 approval she can start work.
She should not go out of US while her H4 to H1 COS is Pending becase COS is Abondened if she departs before COS is approved.
