New H1 extn I-94 number differs from the I-94 number found in my passport

Dear All,
I have applied for H1 extension and it has got approved with a new I-94 card attached in the bottom of new I-797. The problem is, this newly approved I-94 number is different from my original I-94's number found in my passport(which is valid for one more month from now). What step should I need to take? Should I apply for a new H1 or correction in I-94. I learnt that I-94 numbers should be same as that of the one in the passport. I never went out of the country since I have applied for extension. My lawyer used my expired(3-years before) I-94 number instead of the valid one from the passport, when she was filing for H1 extension and it does not reflect the current valid I-94 number found on the passport. Also from the date of applying for the extension until this approval date, I never went out of the country. Please send me your valuable suggestions.

Did you give your new I 94 card copy while extending your H1 visa. I feel your attorney must have taken your I 94 copy from your old file.

Your current I 94 must be extended ask your attorney to make correction.

My attorney applied for H1B extension using my previous old company's expired I-94 information AAA, which expired on Sep 2005. I went to India on Jan 2004, when I come back, I got my present I-94 number, by which she applied for the H1 transfer and it has been valid until Jun 2006 it is BBB. Now I need to apply for a 6th year extension from this new company. But while applying for this extension she applied using the very old I-94 number(AAA) which I had before my visit to India. Hope this explains the situation well.

---------- Lawyer did a mistake writing the old I-94 # on form but you dont have a problem . your H1 was filed on time before expiry of your I-94( that is attached in passport) and lawyer also attached the copy of that I-94 with filing H1 papers but wrote the earlier I-94 #.

------------ you dont need to do anything USCIS knows your past I-94# and it does not matter if it is 12345678 or XYZZZZZZZ on I-94 what matters is that you have valid I-94 extended by USCIS. you can talk to your lawyer he /she is going to say it does not matter. relax!!!

Thanks a lot. I spoke to my company attorney and he has been saying that it shouldn't be a matter and dont have to worry about it, since USCIS had already approved the H1 extension. I was worried about extension of I-94 with same number as in passport. Thanks a lot to Rajiv Khanna's website. Here the response is much better than and quicker than their rival forum where everything will be trimmed off and lots of delay.

I also have same issue, my new H1B approval shows my old I-94 because my mistake my attorney entered the old I-94 instead of the one which I got while entering into USA.

I am going to India for a short trip and just want to know your case, does it matter? Is it something that I overstayed as per my old I-94 as it was only valid till OCT 15,2009.However i got my H1B extension with new I-94 before Oct 15-2009 but with a different I-94 number.

Please help me it's urgent.

I-94 number 1234567 or 1248976 does not matter. if your H1 was filed BEFORE the expiry of I-94 and got H1 extension or H1 transfer approval with I-94 attached then you were on valid status.

When go out of US surrender ALL the I-94 at airline counter. Staple the latest I-94 at top and then old I-94 give both I-94 stapled. Keep the copy of ALL the I-94 front and back for your future records.
