After waiting almost 11yrs, we are finally beginning to hear from USCIS on a family based petition (sister filing for sister & family), My sister received an Affidavit of Support form and paid $70.00 processing fee. Next I received the Agent of Choice letter (myself) and since then they have sent forms for each of us to pay $400.00 for Immigrant Visa Processing.

My question is.... if we are to do an adjustment of status as we are in the USA, do we still send in the $2,000.00 for 5 of us or do I wait until Priority Date reaches (June 1998) and then file I 485 or what?

Can any of you out there throw some light on this and then tell me what comes next.

Thanking you in advance.

are you in the US legally?
did you indicate on I-130 that you will do AOS or CP? Apparently you indicated that you were opting for CP.

My sister filed paperwork in 1997 whilst we were still in Venezuela, we came to USA in 2001 and informed them of our current address, so therefore I-130 was done years ago. We received an Agent of Choice letter and I put my name and address so that all correspondence would come here to us in Florida. What I'm trying to find out is if I have to wait until the PD becomes available to pay the National Visa Center the money or do I pay it now and continue processing whatever paperwork they send meanwhile waiting on the PD to become available. (A bit confusing)....

Thanks in advance.

under what status are you guys in Florida?

I do not think that we fall under 245i because that had finished in April of 2001 and we came to the country in June 2001 and stayed on, and have been surviving with the help of my Mother and Sister both citizens of USA, obviously USCIS has to know that you have to survive somehow especially when you have children involved.
