Need help and advise on my H1B

Hi there, i was hoping someone can advise me on my problem. I am on H1B Visa, i got here last July 2000 so it will be my sixth year next year. My problem is how to get my visa extended for the seventh year. My H1 got approved last APril 2000 but i did not land in the US until July 2000. DOes this mean i can stay until July 2006 or April 2006?

There are no pending application for my greencard due to some circumstances. What are my options to get my H1 extended at least for another year until 2007? What are my options here? WHat if i can get an LCA from another company and willing to transfer my H1? Is it still too late? WHat else can i do other than GC marriage ofcourse :D ? I would really appreciate any help. Im really confused PLEASE ADVISE :confused:

You can get extn beyond 6 yrs, whatever the days you are physically out of US in your H1 6 years period.

Your six years count start the day you entered in to US no the date on the visa stamped on your pp. The extra 3 months extn is not going to help you, your since you do not have any LC pending. Go for any approved LC for 'Substituiton of Aliens' may help. Otherwise F1, if you have your spouse on H1 you can go for H4 to stay in here

Hello all,

I am hoping to get some information regarding my problem. I applied for first H1B on Nov 98 and since then I have been working on H1Bs with different company.

I have a valid H1B till June 06 with the current company. Will I be able to apply for extension when it expires next year?

And another question I have is regarding green card processing. I have applied for Green Card (Labor cert) while I was with the previous company three years ago. Will they be still able to sponsor for the Green Card?

You can extend your 7th yeaar, provided you have any your Labor Certification pending more than 365 days. Per your second question , it may be possible, if the LC is not withdrawn yet.

Thanks great_guru. I contacted another lawyer and he said the same thing as you said. This site is great and will recommend to others.

Yes. Filing thru a lawyer is not required. Your employer can file on its own, if they know how to complete all the formalities.
