ND 2005 Approved!!!

My wife's 485 was approved today. I kid you not. She was a derivative asylee who got her asylum in 1999; other than the asylum grant date her timeline is exactly the same as mine. We mailed the original applications and the RFE's in the same envelopes. Of course, she did not have to do a I-602 like me.

Her status was 'unavailable' online last night with a LUD of 12/20, and I said to myself 'can't be.. must be some technical glitch or transfer to TSC' but sure enough, email at 5:45 AM, and online status also shows approved.

I am only 21 numbers behind her in the LIN queue, but being a male (not to mention my I-602) I suppose I am going through the full background checks.

This confirms my suspicion that CIS is doing some last-in, first-out processing. While I consider myself very fortunate that my wife was the beneficiary of that, I am truly sorry for all the people stuck in the hellhole of CIS backlog (including myself)

BTW, we received 3 copies of the following email.

That's a great news, which confirms that BCIS is going to eliminate all the backlogs (up to ND 2005) by September 2006. For those late NDs (2003, 2004 and 2005), you guys are so lucky...
 
Indeed great news for you, but this is not fair for the rest of the people waiting for more than 5 years. As much as I wish to believe the backlogs to be eliminated by Sept 2006, I strongly doubt that. USCIS is cripping me out now, they are randomly approving applications, separating families and creating confusion among people.

Thank you. Note that I am still not approved, so I am part of those split families. It will be interesting when I travel with my 2 USC children and my PR wife, and me on my RTD.

By the way, I am probably one of the oldest asylum approved, no-PR people on this forum (1997)

My asylum was approved in 1994. :D

Please don't ask why I didn't apply for PR...

My wife's status showed the same LUD before approval--I think you are going to get the good news by Friday!

Congratulations to you and your wife !

I think this is a great news for the whold forum because at least it proves BCIS is really doing something though certainly not fair for 2000-2001 ND.
But I also think BCIS may have considered your long history with them ( as you designated " Don't ask" ).

So, I would imagine Dardan or his/her derivatives will be approved soon just like your wife.

You will have a real pleasant Xmas..

Congratulations! It seems that USCIS pays attention not only to the date of I-485 application, but also takes the case history into consideration. This is quite reasonable.

It looks like your fisrt I-485 has been submitted so early (AA oct 96 ND jan 97= 3 months after being granted asylum status) and they probably returned it to you and you certainly didn't get it back.

If UCSIC had been paying, at least, some attenion, folks like Lazerthegreat, 14ksusha and myself, should have been approved a long time ago. :mad: Meanwhile, I'm under the impression that the processing is done randomly. My point is proven by the fact that I received all my bio appointment notices later than most applicants with much later ND.

You are absolutely right ... it is randomly. Can the INS be sued because of this?

Wow, they had to file the mandame??? That is extraordinary; sorry you had to go through this.... The writ is usually the only legal remedy in such cases, but not very commonly used. I am sure you have a good attorney (obviously you have an attorney).

Who issued the writ??

I wish I knew that! I contacted my congressman about two weeks ago. And that's not going to work, I will explore the options of another class action. I'm sick of it!!!!!!!!! :mad:

Congratulations Floyd .This a good News for ND 05 . it means i will have my card on before april 2006
 
I feel for you. The way USCIS works is ridiculous. I, myself, am always worried and under pressure if the things will go smootly and trouble free until the moment I have the green card in my hands. Since the green card lottery is expected to be cancelled, (don't know if it really matters to us but...)I hope uscis will start working toward adjusting the people in hand, who are already here.

You read my minds :) I was just gonna say that since the DV Lottery is to be eliminated, hopefully they'll have more time and people working on other types of I-485. I have a feeling the way they manage approvals is as follows - they added 174,000 asylum based I-485 from previous years to a backlog elimination but at the same time they decided to approve right away all new cases with ND 07/2005 and on, while working on the old cases (some people with ND 2000 are not approved yet). I am glad for the new applicants but it's certainly not fair for those people who have been waiting for years.

I did have conversation today with nebraska immigration officer by phone.
the officer can't believe that ND2005 case was approved.
he told me the only explaination is that the case was based in samething different than asylum!!! may be refugee status he said
