I did have conversation today with nebraska immigration officer by phone.
the officer can't believe that ND2005 case was approved.
he told me the only explaination is that the case was based in samething different than asylum!!! may be refugee status he said

:D :D :D

I can actually believe it. I think the break point was June 2005.At this time USCIS introduced their Strategic Plan and announced that all asylum based I-485 were part of it and even gave the number - 174,000 cases. All application with ND 06/2005 and earlier were added to the elimination backlog mess and those with ND 07/2005 and on began to receive BIOs Code 3 and RFIs within a few months after filing I-485 while many people with ND 2004 haven't received even BIOs yet. A friend of mine who filed his application in August 2005 did his BIO and is taking medical exam next week. That is the last step before ones gets approved unless they don't ask for additional evidence. My ND is 05/2005 and I didn't get even my BIO.

Trust me, I did not beleive it either at first. The receipt was at work, and I saw the approval when I was home. And I immediately thought "damn, I must have entered the wrong LIN# for my wife's application in my profile and I am seeing someone else's approval. This was after seeing the status updates online for each RFE, etc we sent back. I almost didnt tell my wife until I made sure, but I could not keep it in. The next day, I verified the receipt # and then I was convinced.

I just hope we will not get a blue letter stating "oops, we made a mistake.. you are still not approved."

Now I wait for mine.. I am male, with an arabic-sounding name (I am not an arab) and I had to do a I-602 for a false claim of US citizenship. So I guess I am going to wait for a lo..ong time.

I wish everyone on this forum good luck, a speedy approval, happy holidays (or insert your favorite greeting here) and a happy 2006.

If UCSIC had been paying, at least, some attenion, folks like Lazerthegreat, 14ksusha and myself, should have been approved a long time ago. Meanwhile, I'm under the impression that the processing is done randomly. My point is proven by the fact that I received all my bio appointment notices later than most applicants with much later ND.

I was told by my lawyer that all depend on your name checking is clear or not. Once INC get your name checking clear report, you G/C will be approved soon. Somebody's backgound is complicated, so it will take longer time. USA government is really digging your background as " True ID" law requies.

It looks like your fisrt I-485 has been submitted so early (AA oct 96 ND jan 97= 3 months after being granted asylum status) and they probably returned it to you and you certainly didn't get it back.

RD Aug 22,2001
Approved Sep 15,2005
GC Sep 20,2005

No, it wasn't returned, they accepted it as it was and worked on it for a while and then lost it when moving files from once warehouse to another, I mean, literally, lost it!

Wow, they had to file the mandame??? That is extraordinary; sorry you had to go through this.... The writ is usually the only legal remedy in such cases, but not very commonly used. I am sure you have a good attorney (obviously you have an attorney).

Who issued the writ??

Well, it's been filed with a Maryland district court. The writ is to force USCIS to act. The judge is yet to make a decision on it. My lawyer thinks it's the only way to make them act after having waited for so long. We'll see what happens, I will keep you all posted.

Did you speak with the real immigration officer or just the 800# call receiver ?

My ND is 10/31/05. the USCIS reqested evidences from me, so I contacted them to why it is so quick. The Immigration officier told me that they are waiting for my G-325 A and Bio to approve my i-485 since everything is Ok

It sounds to me like a convenient excuse. I have a very uncommon name. For 10 years of presence in this country I have never heard of a person with the same last name and there's nothing complicated in my backgound - I never even travelled outside US all these years. Therefore, I am not buying it. Thanks, anyway. :)

I totaly agree ... I know people never traveled and with none arabic name and they simply disappear in the backlog whole. This is the sad reality we are facing now with INS. Some ND05 approved and ND99,01,02 still waiting. I wish someone can explain the logic with a knowledge not assumption.

Some time last week I spoke with an "immigration officer"(who, in fact, is just a contractor) from the national 1-800 helpline. She was very sympathetic, but dropped a hint that she's been monitored and told me that she could not comment the fact that similar cases with much earlier ND have already been approved and only could suggest to contact Nebraska Service Center, which handles my case. Yesterday I received a certified mail confirmation that they received my inquiry letter, which contains printouts of this forum. Let's wait and see. Meanwhile, my code 1 has expired.
