Namecheck pending applying again thru employer

Hey people...

I have applied for my GC thru my spouse and had my interview in June 2006,but it has not been approved yet,due to pending name check.
Meantime I am running thru problems with my wife and we are not sure if we would continue(although we both are trying our level best)..
Meantime my company agreed on applying for my GC and so I have given them the green signal.
My question is,can I do this?
Can I apply for my Employment based Green Card while my initial GC(thru spouse) is pending?
What if I get my conditional GC?Can I still continue with my employment based application?

Yes you may apply for an employment based GC while your spouse based one is processing. However, this option is not possible if you came into the country on a K-1 visa sponsored by your wife.
They day you get your conditional GC approved, your employment based application seizes to be valid. GC holders cannot apply for PR

GC holders can apply for permanent residency in a different category, however, they can't do AOS, they must do consular processing.
