Name check pending for 22 months!

FOIPA is easy to obtain (2-weeks) from FBI, but it does not help your fingerprint much. But still, go right ahead fax over the request.

I at least would like to know why they are waiting for last 16 months to clear my name check. I am only guilty of having a common Indian name (not a Muslim name - no offense).
My name check has been pending for 22 months, and I've tried many things. Yesterday I got a letter from the useless senator, saying that he understands my situation, but couldn't help.
My fortune 100 company would not do diddle squat to help me out in this situation. I am lossing my sleep over this. I just don’t know about my future in this country after living here for 8 yrs.
In big companies, unless you can reach someone high in the rank, nobody cares about your issue, sadlly. I am in a small company, but our parent company is a fortune 500 company. The response from parent company is nothing, while my HR director was trying to help by sending letters to congressman... Even though not much to help, but I'd appreciate their willingness to help...

I didnt know that having a common name will give problems with name check...Is that based on some concrete information
 
Some more info on this, but not much!

I have my congrennman called USCIS yesterday and told here is what happened: for some reason, USCIS did not like the way FBI checked the names for 2.7 millionion requests, so they push them back and redo it. Now most of them are done except about 4000 left. We fell in these 4 thousands. Even our Congressman know this is an efficiency problem.

My congressman office tried to call FBI, but told they did not take phone inquiry now, they only ntake fax. I am wondering if there is an different number to call. Does any body have your Congressman call FBI for your name check? Do you ahve the same experence? Can you share an different number if you know?

We have been waiting too long! It is an violation of human right. It is not fair for us to suffer just because we have an different name. So I am wondering if we could put our email address here, organize an email group. So we can consult some lawyer or human right organization to do something.

That's no wonder! My congressman office called me last week, saying that he is going to call FBI to find out what happened to my name check, and will call me back in 1-2 days. Now 1 week passed, I still haven't heard from him.

Now that you mentioned that FBI no longer accept phone call inquiries from congressman, that probably explains why it takes him so long to contact me.

FOIPA has not much use

I did such request and got a no record within 10 days.

Then sent a letter to the `honorable' David Hardy who hasn't replied me yet.

I don't think there is any use of doing all this.

The US government would like to torture immigrants using such infinitely waiting game.

In US, immigrants have little rights. They can be jailed without charges for indefinite amount of time. Similarly, immigration application can be delay for unbounded amount of time.

guesstimate

Does anybody has a estimate that normally how long does it take to finish name check. Not only FBI but from all the agencies. It will be good to know so that we can try to be patient for that time period. It is so agonizing to wait endlessly.
 
I have seen people waiting from 2002 and still haven't got GC yet.

I guess, the wait could be as long as more than three years.

In Feb 2005, got an email from FBI saying the case is still pending.

Did FOIPA, got response rather quickly, "no hit"

Contacted the company (Fortune 100), was told that they could not do much until USCIS processing date passes my filing date. (I doubt that even that day comes, they still won't do much, however, they do not seem have any problem to pay thousands for EAD and APs year after year).

Contacted local Congressman, not much help so far.

Really realy realy tired and almost want to go back to China now.

How many three years we have in our best age?

Yes, buddy, I totally understand. My 485 was filed Feb 2003, and name check pending since Sep 03. I've tried so many things myself, pretty much useless.

The company wouldn't care much about it. They would be happy that you stuck with the name check, means you'll be stuck with the company for years to come.

Congressman or senator wouldn't help much for one, your RD is not yet "current" per NSC processing date; for two, they can't do much to speed up your name check, it is out of their hands. The best bet is they do status inquiry on your behalf on regular basis, say every month or so.

If you really want to go back to China, take a break and travel back, I am sure you will feel better instantly! :cool: :cool: In fact, we are planning to go back for a month this Dec, don't really care about whether I-485 approved or not.

I saw many of you had an inquiry for Name check. My 140 was approved on 5/5/04 and waiting for 485 approval. I would like to check my name check status with FBI. Who can let me know how to draft an inquiry. Please send me a format through email, I can add my info into it and send it right away. Your help will be appreciated.

It is not unusual for a chinese stuck in Name Check like you and me. cuz FBI admitted that its database has difficulty to identify chinese name. As to writ of mandamus, you got to prepare it carefully and be ready to take some risks. That means if the judge decides to compel INS to make decision on your case in 30 days, it might not be favorable decision since INS can simply deny your case for incomplete Namecheck. If you want to sue FBI, I don't know if any judge would make a decision against National Security. Ask experienced lawyer for legal advice.

That's what I am afraid of. A judge cannot order CIS to "APPROVE" your case, but can only ask to "make a decision" within a short period of time. THere is a possibility that the decision is not on applicant's favor.

I know for Citizenship Naturalization, there is a 120-day law (after the interview) that USCIS needs to comply. But for immigration (except for lottory GC), there is nothing like that, and it's up to the judge to make the decision I guess.

You can ask the judge to order USCIS make a decision in 2 weeks, but USCIS can also ask for extra 6 months to clear name check... So the thousands of dollars may not bring you the result you desired... :( :(
 
I just wonder if we can persue a settlement with INS and let them contact FBI for expedition. I am not sure, But gotta ask some lawyer who dealt with this kind of case before.

Same situtation -- Name check question

I got a mail from FBI stating:

I am responding to your email dated November 30, 2004, concerning your name
check status for immigration purposes.

The FBI completed a name check for you on March 21, 2003, and the results
were forwarded to the U.S. Citizenship and Immigration Services, Washington,
DC.

-- When I called my local congressman to followup the lady was extremely rude and initially tried to get away saying that it doesn't matter if your case has not been approved and its pending for more than 9 months more of the date posted on the USCIS site. On further request she called up NSC and they told her that they are sending me new FP notice. When I called her again after 1 month she told me without inquiring that they are waiting on my secutity clearance. When I thought its the same as name check and send her this email from NSC she came up with an answer that this email doesn't say that it is cleared and I will have to wait until it is cleared.

Guys does this email mean that my name check is cleared or it is pending? How can I make sure that NSC got the results from the Washington DC office. Is there any address or phone # I can call to check if the results were sent to NSC?

I believe your name check was cleared. You can also contact your senator, the congressman of your employer (if under different district), your attorney, or you can directly talk to NSC officer, fax your supporting document to NSC, etc. Your choices are wide open! Congrats!
