Name check pending for 22 months!

We don't have more details. That's all I know.
Probably what adds to it is that his father was a goverment and party official before retiring and visited over 50 countries. Probably something else that even he doesn't know or can't tell me. Probably the analyst is just some very pissed-off guy who sees a spy in everyone.

Good luck to you.

udacha,

I guess it is what happened to my case. It is 20 years now since I was in the university (MGU Fizfak) and signed those secret papers. So fbi probably didn't do anything, just waited for 20 years to come, and finalized my name check after that.

Well!!!

WAAAAA!!! The time I was writing this letter. I got a call from the congressman aide who was inquiring FBI for me. And she said that the reason NC is delayed is because I got VERY COMMON LAST NAME (Not too rare, but I didn't think it was that common)....geee

The senator told us that there is some indication that our home country intentionally delays releasing some of that information to force people to come back.

Ha

So they do go back to the records in home country! Today was a very educational day.

Slt,
What you had then wasn't an "IDENT", but it was a "HIT". All I can say is according to the congressional testimony I read hits are more difficult to resolve and they normally occur with the Chinese names, not Slavic (our middle name gives away your identity). You may still have an IDENT, once they identify who you really are.

The subject of the testimony is different but gives you an overview about how the namecheck works.

Good luck and May the force be with you;)

I got increasingly impatient with my name check, so I contact an attorney for an estimate and a few concerns, and would like to share with you.

"A mandamus can increase the risk of denial if there is a basis for denial. That is why we would want to review the case first.", that's from the attorney.

Cost estimate from that law firm is $3500 plus hourly if going to court. However, they said they "never had a case that goes all the way to trial". That means, the initial step of "legal complaints" letter from the attorney is powerful enough to get the USCIS and FBI moving.

When I ask for reference with successful experience, they wouldn't provide citing "ethical reasons", but claim "always successful". I personally think they are experienced handling these cases, but still prefer to hear some successful stories from their satisfying client first...

Belle is right, it is just a pain in the b*tt. Unless it brings me too much pain, I probably choose to wait a little longer, considering that a law suit can increase the risk of denial...

Good luck to us all,

Well, thanks for the information. For me I couldn't allow my case pending for more than 2 years. I will go ahead and do that if it won't get approved in projected time frame. If they want to deny my case so be it. At least we can go back to china to make more money. Right?

BTW, I read somewhere Mr. Hardy admitted that chinese name is more difficult to clear. That might be very true. If you are a chinese you know why.

Hi, Flyer010, you are welcome. Yes I am from China also. My last name (LIU) is very common, however, my wife's last name is the same (talking about how common it is :) ), and her name check got cleared long time ago!

Yes, we thought about going back to China and making big $$ all the time... However, the longer you live here, the more afraid you are to go back. I remembered the first 2 years when I came, I sweared that I would go back to China once I got my MBA degree. As times goes on, as I got a job, met my wife, had a child, I am just feel afraid of going back. Just too much of concern, some for self, some for my son. Maybe I just missed the best timing going back to China. My father used to have some connection for business...

Well, you are right. When you have family and kids, it is just hard to make a big move. But it is always an option. Greenback worths nothing right now. And it will be much worse. So we are not here begging for green card.

Slt,

Surprisingly H1B namechecks are never long regardless of who is applying. My husband has had two H1Bs (two different employers) and his biography never bothered anyone before. Even Saddam Hussein can pass it. But once it gets to the GC stage they turn you inside out. Five years ago my husband's immi lawyer recommended that I should apply as a primary instead of him because she thought that this delay was likely after saw his millitary rank etc.

I think I have no such problems, but I have very common name. Probably that is why I am stuck in name check. I am confused even my name is common but my background should be different from other people. Why does name check take so long?

I don't know. It was not just H1B, it was DONKEY MANTIS (people who work with DoD contractors, critical technologies). According to FBI, it is a same thing. I had to fill additional forms and submit the same info as in G-325A biography. However, you might be right. Never know

Adding to this, I did not even spend a minute in the army. I was given leutenant-in-reserve automatically upon completion of "voennaia kathedra". But well who knows.
