name check found pending from senator

My 485 has been pending over 2 yrs due to name check. I finally contacted my senator, who contacted FBI. FBI responded saying name check is 'pending'. Has anyone got this response? Since all the cases I've read so far, generally FBI clears the name check once the senator contacts the office. I was backing on that and am very disappointed with this response.

TIA for any experiences you can share
 
In my case FBI did exactly that.

There is no guarantee that contacting senator will lead to your name check getting cleared.

Senator contacted FBI... received the "name check pending ..." response
from FBI...

I got the same "Name check pending" since 2005 response.
Is there any thing we can do? Can we request USCIS to expedite since our priority is current. My lawyer says we can send a letter but it is unlikely to cause any difference.

Other option is to just sit and wait for this dreaded name check to get over.

This is very common. Elected representatives can help you to expedite your name check, if they want to! Generally, they just send an inquiry to FBI. If you can convince them that you are really affected by this delay or if your employer has some influence at their office, then they may do something. I've tried several of the things mentioned. Have repeatedly sent emails and mails to FBI name check division. Not a single response. It is really like some people mentioned, FBI name check clearance is more imp than approval, because atleast we have some timeframe there.

Really depressing....
 
You know considering a spate of responses which FBI sent to Senator..looks like a mass response to enquiries by FBI.

I have been trying to get the senators office to get a response from FBI since Feb 2006 and now suddenly this response and on same day we seem to have others as well who got their responses. It so happens that the response is same for all enquiries.

Just thought will share this observation with you guys.
 
Just want to share my experience and see if helps. My case info - PD 7/2001; 485 ND 7/2004. name-check got cleared last month.

I started to contact my local congressman's office 1.5 years ago and was informed that my NC was still pending. Two months ago, the lady responsible for immigration affairs said she would make a formal enquiry with FBI for five cases that had been waiting for too long. One week ago she called FBI again and learnt my case was cleared.

It's possible that FBI are processing mid-2004 cases, based on a number of similar cases reported on this board. But I still feel the local congressman's office helped to some extent. I am not sure of the role of Senator's office since they send enquiries to FBI in batch.

One interesting thing I learnt from a recent infopass that the 485 cases enquired thru congressman's office are labeled "Congressional cases" and USCIS have special unit to process this kind of cases.

I was stuck in name check for more than 2 years.
I think asking help for senators and congressman to expedit name check won't help. At the most they can inquire FBI to get your status and that itself might help to bring ur case in open, incase it is hiding behind and no one is looking at it. But I seriously doubt senators will go extra mile to ask FBI to expedite name check. In many cases, name checks are stuck due to overseas inquiries, which means someone in your home country might be actually sitting in your query. In that case, FBI might not be able to do anything.
But if you have a GENUINE case where delay is affecting you personally, you can directly write a letter to FBI and explain your situation. This has better chance to expedite your case.

I started to ask congressmen's office for help since last September before the retrogression began. It came back with 'Name check pending'. The lady in congressman's office said she had several cases similar and she followed up these cases with FBI every two weeks. Till now, my case is still pending name check. In my case, the congressman's office only helped to inquiry, but expedite.

485 RD: July 2004 (PD: Nov 2001).

I sent a second letter in March 2006 requesting status on my name check. (Without reference to the first letter that i sent in june 2005).
On sending this letter, i received a call from the Congress person's office stating that they already have my case on file and are following up with FBI every month since June 2006.

On 15th June 2006 I received a call out of nowhere from the Congress person's office that the name check has been completed and returned to the USCIS and they will follow up with USCIS further.

FBI name checking pending since 10/2003.

I worte to FBI, INS, congresman and even reported "Case Problem" to INS. So far, my case (I-130/I484) has been pending on FBI name checking for 35 months.

I am thinking about if I should lawsuit INS/FBI? Does anyone know any good lawyer who can handle this kind of cases at Bay area in california? Thanks.

I saw on Cspan (house of rep) channel today (7/27) an amendement moved by congress man from NY Jerrold Nadler (D) for apprpriations discussions.
He mentioned excatly the things which all folks here stuck in Name check want to highlight. Including plight of people waiting for 2-4 years to get name check completed. As per him more than 130,000 name checks are pending with FBI and only 12 people work on it. Unfortunately the amendment was defeated. However some one from Congress said this is fee based process and FBI is simplly not chargin enough and it has been asked to submit a report by august n how it is going to tackle Name check back logs.
Folks from NY should appreciate the congress mans effort by sending him emails and asking him to continue to do whatever to get all legal aspirants justice.

Hope some thing good comes out for all of us.

I contacted Congresswoman Anna Eshoo's Office, they are very helpful.
Possibly send a Fax to request for status on Name check.

Yeah, so much for the national security.

The congressman should focus on actual national security concern
with under-staffing rather than the time delay.

This is getting pretty ridiculous...
