N-652 "Decision Cannot Be Made"

Hi all,

Is there anyone who came out of the interview with a "Decision Cannot Be Made" for reasons other than the FBI Name Check pending?

My IO told me during the interview that she needs to check my passports with my travel dates on the application since I've done extensive travelling over the last 5 years however none of it has been more than 6 months and the total duration out of the country has been around 580 days (i.e. far from the 2.5 year mark).

Anyone else with similar experiences, please do share.

I am awaiting my oath letter patiently.

It could be because of various reasons. In addition to the pending name check, discrepancy in travel dates reported in the form, indication of tax payment irregularities, citation related discrepancies, etc., are just to name a few. In short, indication of lying under oath is one of the main reasons other than the name check gotcha.

The IO said a decision cannot be reached because she needs to carefully check my travel dates on the application with the photocopies of my passports (old and new). I have had extensive travelling but nothing that exceeded 6 months, but many stamps and many short trips totaling 580 days out.

Would that be a good enough reason for her to do that? At least this is what she told me.
 
Do you have quite a few trips abroad?

If someone has 20 / 30 foreign trips listed on their N-400 form, then IO don't want to go over all the stamps during interview since they have limited time to complete the interview. IO will tally all the stamps with trips listed and recommend you for approval, if you have nothing else to hide.

Sit back, relax and wait for the Oath letter in the mail.

From what I've read, getting a "not at this time" decision is quite normal for some DO/IO combinations. Seems like certain locations prefer to err on the side of caution while waiting for the case to be reviewed by a supervision. Its certainly nothing to get worried about unless you were specifically told you hadn't cleared namecheck or had some other issue (e.g. unresolved citations etc).
 
Yes, in y N-652 the IO officer marked, decision cannot be made, the reason they have some files on me at National records center, they have to get them, consolidate etc and send me a letter. It is 2 and half months now, they are still waiting for the files.

I don't see why you need to worry, they are just checking everything, but how long it will take??? nobody know. Wait for a month, take an infopass.

Yes, that certainly is a good enough reason for the IO to not make a decision on the spot. But since all your travels do not violate continuous residency requirements, you don't have to worry too much. Just wait for a month and if final approval does not come by then, take an Infopass appointment to find out what is going on.
 
I get the impression that the Infopass appointment is the "deux ex machina";it may assuage or inflame your spirit depending on your experience.
I do not think it affects in any way the decision making process of USCIS.

wow! Ok so atleast I am not the only person in this boat. I guess this is just procedural. Have you taken an infopass? What did the IO tell you exactly? I see that you did your interview almost a month ago, any updates whatsoever?

Yes, you are absolutely right in terms not being able to influence a decision. But it does help you getting the additional information that is usually hidden from you. As a matter of fact, calling the National Helpdesk is a better way to escalate if that is necessary. Both me and my spouse got our respective interview letters by escalating via the National Helpdesk. The reason we know it was the call that helped because immediately following the escalation, we got respective letters from the DO that they got the escalations and they will rectify the situations.

However, Infopass is still the best way to see a human provide you real information as opposed to voice over the phone. Also, Infopass is way more interactive than the Helpdesk.
 
Pending Decision-Interview

My father is in same issue. He was told decsiuon cannot be made unless he submits tax returns, deeds, bills etc. He is retired, no income and lives with us
and travels home for medical treatment. From his timeline he is 32 months in US since his GC.

Please advise..what should we do in this case as none of this exist.

Is he claimed as a dependent on your income tax? Also, can you provide an affidavit that he is a dependent and is living with you? The constant travel back home is a flag for continuous residency break.
 
Would it help for future applicants to copy the stamps on their old passports and send these with the original N 400 application?
